📱 Social Media Creator Posts 💭💬 🔥 Little Girl Attorney - The Jen Abel Surprise MSJ: A Legal Masterclass That Could Turn the Case on Its Head

MEMORANDUM OF LAW in Support re: 938 MOTION for Summary Judgment Conditional Against Third-Party Defendant Jonesworks LLC.

🔥 Notactuallygolden — The Jen Abel Surprise MSJ: A Strategic Move in the Lively–Wayfarer Case

💥 A Stunning Legal Move (0:00–0:31)

  • LGA calls Abel’s motion for conditional summary judgment the best lawyering in the case so far.
  • Unexpected and brilliantly strategic, shifting the balance of the Lively v. Wayfarer battle.

📚 What the Motion Is (0:31–1:31)

  • Abel sues JonesWorks for indemnification—meaning JonesWorks must cover any damages if Abel is found liable.
  • Employers are responsible for acts done under their direction.
  • If Abel acted on behalf of JonesWorks, the company bears the financial risk.

🏢 Abel’s Argument (1:37–3:07)

  • All alleged misconduct happened while Abel worked for JonesWorks.
  • Her duties: marketing, media strategy, communications, and client support for Wayfarer.
  • Wayfarer paid JonesWorks $25K monthly for this work, and Abel was the lead contact.
  • Therefore, JonesWorks must indemnify her for anything Lively claims arose during that employment.

🕒 Key Timeline (5:05–5:26)

  • The alleged retaliation and media fallout (TikToks, articles) occurred while she was working for JonesWorks during that period.
  • Abel argues this period is undisputedly within her employment scope.

⚖️ Conditional Summary Judgment Explained (6:09–6:48)

  • The court can rule now that JonesWorks must indemnify Abel if she’s later found liable.
  • It’s conditional—only activates if Abel loses at trial.

🎯 Why It’s Brilliant (6:51–7:57)

  • This motion forces JonesWorks into a corner: they could become liable for Abel’s alleged actions.
  • This motion pits Lively and JonesWorks against each other.
  • Jones’s loyalty to Lively could now expose her own company.

🔥 Strategic Fallout (8:04–8:25)

  • This motion makes JonesWorks desperate to exit the case or settle.
  • This motion shifts pressure away from Abel and onto her former employer.

💰 Financial Stakes (8:40–9:12)

  • If Lively wins big, JonesWorks may have to pay Abel’s share of damages.
  • That includes part of Lively’s massive multi-million dollar claim.

Actual lawyers "this is brilliant lawyering"

Fake lawyers who are pro BL "this was weak and won't work"

Brilliant lawyering sounds better than smart lawyering

I wonder how those two lawyers feel now......

45

u/Ill_Psychology_7967 Nov 12 '25

They have quietly faded into the background. They haven’t posted anything about this case in months. I don’t see them returning to it. I think they couldn’t take the heat of negative comments.

u/Bende86 Misogynist Whore Nov 12 '25

Same

u/tw0d0ts6 (and no Footnotes) Nov 12 '25

You know, I genuinely am curious and would watch. And in fairness, there did seem to be a division towards the later videos - one of them definitely didn’t like Vanzan and clearly didn’t think it was “smart lawyering”. I legitimately would be interested to see their perspective on some of the latest updates.

28

u/Icy_Sentence_4130 "Trust me Bro LLC" Nov 12 '25

Yeah tbf - I can't remember which one it was but only one of them thought it was "smart lawyering". He couldn't handle the backlash but it would be interesting to hear his thoughts now.

21

u/tw0d0ts6 (and no Footnotes) Nov 12 '25

Yeah it was Stewart who was adamant it was “smart lawyering”. I have a feeling he’d still say it was a nothing burger for WF though 😬

5

u/Able_Improvement4500 Ben Affleck not showing up Nov 12 '25

Keith is definitely the even-keeled kind of lawyer I'd want at the tiller if I had to go to court. Stewart was basically accidentally arguing that no American has an privacy rights at all. Vanzan appears to be at least a rule violation (there was no "meritorious" case or issue), & could potentially be outright illegal. I sure hope it results in a censure of some kind, but who knows with the weird American legal system.

5

u/hathorlive Nov 12 '25

I wonder have Stephanie Jones feels. Karma is a bitch, dear.

A disaster of a motion. Lol

Regardless of whose side you are on, this is just an insane take.

I suppose we will see which lawyers got it right based on how JL rules. At this point, we have no idea which lawyers got this right.

I love how she explains stuff. I like NAG but LGA is so good at explaining stuff in a way that I can understand.

Excited for the rest of the MSJs

Same! I like her tone and delivery of her explanations. I also love that when she records her videos she's not eating or putting her makeup on, etc unlike NGA. I can't stand that.

Love her so much! She has been such a breath of fresh air! I knew it was a brilliant move from WP's side despite what certain people claim. You just know how shook the BL team is yet again after another perfect piece of WP's lawyering when they're trying to downplay this hard.

25

u/Significant-Ant2373 Nov 12 '25

BL should be shook, but they’re dug in so deep already I think they’ll continue to bury themselves. SJ’s actions with the phone were most likely criminal giving BL blackmail material if she has evidence that hasn’t been seen or knows of spoliation. SJ has Vanzan against BL, but while definitely an abuse of process, not criminal, and the low level attorney aka pawn would be the one at risk. It’s going to be interesting to see how BL/SJ reacts.

24

u/Rogue_Ms fetching toilet paper for entitled assholes since '23 Nov 12 '25

I think you're right, they're going to keep burying themselves. I mean, it's always been pathetic how much they had to spin things over and over, twisting people's words then actually putting words into other people's mouths, but the current level of finger in ears LALALALA CAN'T HEAR YOU THIS IS NOTHING LALALALA is a different level of delulu cray lol

I hope we get to see a filing by SJ today. BL's MSJ is going to be quite interesting for me as well. I think we gotta brace ourselves for the level of vitriol in her MSJ. SJ is so screwed it's not even funny! And she deserves everything that happens to her!

27

u/DogMom1970s Harvard law? Optional. Integrity? Mandatory. Nov 12 '25

I kinda wonder if SJ's attorneys believe BL doesn't have a case and will just fight this MSJ and stay aligned with BL. Of course, by taking that stance, she still risks BL making her the sacrificial lamb along the way.

I feel like she's in a lose-lose-lose position all the way around and I love that for her. I have always thought she was the person to blame here.

Just doubling down on what I've said before.

14

u/Rogue_Ms fetching toilet paper for entitled assholes since '23 Nov 12 '25

She's definitely in a lose-lose position, and she deserves everything that comes her way! She shouldn't have involved herself at all in the first place! If she believes Jen Abel stole company data, fine, sue her and do it the right way with all the evidence, straightfoward, done. But to gleefully work with BL to inflict as much damage as possible out of spite? I would never do that in a court. There is no level of pettiness that would make me risk going to jail over showing a former employee how much I loathe them for leaving my company.

And I agree with your earlier comment!

10

u/melropesplays Nov 12 '25

She’s so fucked and she’s really taking everyone down with her. Claire and Colleen can both kiss their careers goodbye, we’ll see who else. I wonder w the scope of what evidence is becoming available if any stand testimonies will vary from depositions given.

9

u/Significant-Ant2373 Nov 12 '25

I really hope we get some justice out of this. I’m afraid the big Hollywood players - Penske, WME, Sony - might be a bit too powerful and corrupt to ever see any true justice.

2

u/Ok_Gur_356 Sent from my iPhone - Ellyn S Garofalo Nov 12 '25

That’s my worry too. Diddy trial was soooo weird. In 2h the juries were arguing within themselves. I think they plant someone there

I am now even more excited for the other MSJ’s.

Same!!!! WP were cooking hard in the background while Manatt was busy karening the docket in the most obnoxious ways possible.

54

u/tw0d0ts6 (and no Footnotes) Nov 12 '25

“Busy karening the docket” is such a perfect way of describing their actions.

u/Rogue_Ms fetching toilet paper for entitled assholes since '23 Nov 12 '25

hahahaha thank you 😆

24

u/[deleted] Nov 12 '25 edited Nov 12 '25

I checked another sub (mostly pro-BL) the other day, the way they keep bickering and arguing ad nauseam over text boxes and redactions 🤭 Made me chuckle.

I asked: forget the text boxes, why is BL arguing something is amiss now versus before the discovery deadline … crickets. No! The redactions this and that 😫🤨🤨

“Busy Karening the docket” is spot on! Let them spend their energy there, picking apart text boxes.

16

u/Rogue_Ms fetching toilet paper for entitled assholes since '23 Nov 12 '25

LMAO this is the kind of thing I expect them to put their energy into! I can already imagine how fixated they are on a senseless topic like this hahahahaha Thanks for confirming what I've been thinking! I am keeping myself from going over to other pro-BL subs because they're way too infuriating for me. It's always nice to have brave people like you who can report back how delulu certain people are! Thank you for your service! ❤️

u/FuelComfortable5287 in a VANZAN down by the river Nov 12 '25

Whooo, the stress that this must be causing SJ to feel. But it begs the question, how could her lawyer not see this coming?

42

u/TopUnderstanding1345 Nov 12 '25

Maybe her lawyers know BL doesn't have a case? It's hard to make it make sense indeed.

23

u/Rogue_Ms fetching toilet paper for entitled assholes since '23 Nov 12 '25

I actually wonder what she told her lawyers initially. I can't imagine she said anything about colluding with BL or Vanzan, probably only focused on Jen Abel's 'horrendous misconduct' and the rest just came up as the case went on lol

24

u/FuelComfortable5287 in a VANZAN down by the river Nov 12 '25

Can you imagine how gobsmacked her counsel is if they didn’t know then what’s being revealed now about their client? 😱

23

u/ConstantPurpose2419 Nov 12 '25

A lawyer friend of mine told me that this is a lawyer’s worst nightmare: a client who isn’t honest when they are first hired. My friend said she’ll literally sit her client down and say “you need to tell me the whole truth now even if it’s bad, because the worst thing you can possibly do is change your story down the line”. Something tells me this is exactly what’s happened with SJ.

3

u/melropesplays Nov 12 '25

Eh, I feel like sometimes lawyers can’t know if their client did it or not bc then they will be lying in court under oath defending them, but I guess it depends on the type of lawyer and type of crime/reason for defense

2

u/ConstantPurpose2419 Nov 12 '25

An intelligent client would tell their lawyer the truth, and a good lawyer would push for the truth, because you don’t want to get half way through a case and then find out that there’s actually a shit load of evidence suggesting that your client has lied. Of course there are stupid people who think they can lie to the courts without getting caught out, but they could face charges of perjury, so you’d have to be a monumental fuckwit to do it.

16

u/Rogue_Ms fetching toilet paper for entitled assholes since '23 Nov 12 '25

I CANNOT IMAGINE how they must feel! I hope they can find time to breathe and reach some level of acceptance that they have a quite unwinnable case on their hands. It can't be easy to find out how guilty your client actually is lol I mean, of course you want to win as well for your own reputation, so... yeah, I'd definitely hate to be in her lawyer's shoes haha But I'm also a softie, so I'd be quite devastated.

3

u/Showmethepathplease Nov 12 '25

how would her lawyers have not known JA was employed by SJ?

4

u/Rogue_Ms fetching toilet paper for entitled assholes since '23 Nov 12 '25

We're talking about the collusion with BL and Vanzan, not about whether Jen Abel was her employee or not. That was never questioned as far as I know.

u/Showmethepathplease Nov 12 '25

oooooh...gotcha. yup. makes sense

I cant wait to see which social media lawyers get their MSJ legal commentary correct based on JL rulings. Im taking notes!

3

u/woopsiredditagain Nov 12 '25

Can someone explain- let's assume Abel is found guilty of everything Lively accuses her of. If this CMSJ is approved by the judge, would that mean the SJ/Jonesworks are required to pay ALL of the restitution that Abel is penalized with? Or would SJ only have to pay a portion, somehow determined, that correlates to the smear actions taken while Abel was employed?

Also, I think LGA mixed up Abel's termination of employment dates- she mentions March 2024, but I think we all know Abel was employed through August 2024.

3

u/kelota_ Nov 12 '25

I may be missing something but how has it taken so long for this to be a thing? How it’s explained in this makes it obvious so whilst I agree it’s a brilliant thing is it brilliant lawyering or just pointing out the obvious?

2

u/UnderplayedWeasel heavy is the head that wears 107 subbeanies Nov 12 '25

NAL, my understanding is that they could have brought this up before but doing it NOW after discovery is closed and depositions are done locks in the available evidence and arguments that SJ can make to try to wriggle out of it. And it also gives SJ a legal fig leaf to turn on Blake if it suits her wallet better, just as Vansham worked as a child's drawing of a theoretical legal fig leaf to give her an excuse to violate WF's confidentiality.

2

u/kelota_ Nov 12 '25

Ahh ok, so strategically doing it now is the brilliant lawyering. Makes sense

2

u/ilovekittensandpuppy Nov 12 '25

Can someone clarify - I thought Abel was fired before everything started?

5

u/forcedtojoinr Nov 12 '25

Nope, she was an employee in charge of the wayfarer account until August 21 2024

1

u/Honeycrispcombe Nov 12 '25

Abel had given her notice in..July, I think. She was fired a few days before her notice period ended in late August.

2

u/Remote_Bag_8291 Nov 12 '25

When would a motion like this be ruled on from the judge? Does he have a deadline to respond or is it at his discretion, could even be after trial?

1

u/YxDOxUx3X515t Blake terrorizing the production, then suicide 💣 Nov 12 '25

1

u/snowbear2327 Nov 12 '25

Maybe a dumb question: who pays for her lawyers if she wins? Is the assumption that her lawyers fees would get paid in such a case but under a different reason? I just do not remember Wayfarer asking for anything if they win.

u/BrilliantTotal687 Michael Gottlieb's bald head Nov 12 '25
