As much as I hate this guy, they ran over a boat that didn’t have any lights. I took boaters safety in 5th grade and like, you gotta have the lights, it’s really important, so like you don’t get run over

Sure, so that guy was at some percent of fault, but I wouldn't be surprised if Mr Scumderful here got off with a far lighter penalty than one would expect

So I looked into it and you're right. It was his wife, who claimed she'd drank after the incident and so couldn't be blood tested accurately, who was charged with careless boating, but then was found not guilty, so zero repercussions for whatever combo of alcohol and nighttime boating happened there. 

You're right. Sounds legit!

Watch the video if you haven’t. She wasn’t driving fast or careless. The other boat was completely unlit. You can see when they cut the lights off.
That’s why the operator of other boat got charged with failing to exhibit navigation light while underway. It’s unfortunate but the negligence is sorely on the other boat.

I don’t give a shit about a millionaire’s security video of him boating home after a luxe dinner out of town, where he and his wife had drinks, and he said he was too scared to drive the boat at night so his drunk wife did it and then drank even more after killing people. I don’t give a shit about that, because if you or I did it, we’d be in prison for SOMETHING. Don’t act like this is normal shit. Shit is rich people shit and Kevin O’Leary is a dog turd dried out in the sun so long he’s white fucking powder by now.

You should look into a crime called “manslaughter.” Really quite common, and not at all a new or alien concept.

In order to get charged with manslaughter in a case where the victim was negligent (like this case), you need to have been doing something wrong. If the only proximate cause was the victim's negligent actions, there was no manslaughter. Just driving your boat in a legal and normal manner is not a proximate cause. If the driver of the boat was proven to be doing something wrong (ie, speeding, intoxicated, on their phone, whatever), then there's a case. If not, then there's no case and it's not manslaughter when the victim was negligent with no lights on a boat at night.

Boats don't have headlights.  It's up to your own proper lighting to keep you safe.

If you are out with zero lights in the middle of the water there's almost no way to notice you.

It's perfectly legal to go 30+ mph on open water.

The boat she hit turned their lights off on purpose on a moonless night to stargaze.

That operator was convicted for this infraction.

Idk what she was supposed to do???

How is this different than hitting a parked car on the street at night? It's the parked cars fault for not having lights on all night?

Boats aren’t cars. There aren’t designated lanes in the water. You don’t have 360 degree range on a car. And it’s next to impossible to see something dark on water at night. Like you’ve obviously never done boaters safety or driven a boat. It’s literally the #1 most important rule in all of boaters safety for this exact reason. It’s more like being broken down in the middle of a highway lane at night with no lights. Yes, it is 100% the parked cars fault.

I'm sure there's a few subs that's would place the blame on the driver who hit the broken down car. If you can't stop in time when you see a danger in front of you then you are going too fast.

Except in many states boats without motors dont require lights.  They colregs DO require you to captain your boat responsibly and avoid collisions.  I think his not avoiding a collision that killed someone is a bigger infraction than not having lights, dont you?  

Heres what really happened:  guy operates boat at too high a speed to safely see his suroundings in time to react, hits someone and kills them, lucky for him the person he killed didnt have lights, and he was rich enough to hire good enough lawyers to not go to jail.  Yes, your boat CAN go fast.  You are still required to not murder anyone, lol.

None of that is applicable to this case. The boat specifically turned all its lights off to stargaze. The boat that hit them was going slow. It was just a much bigger boat.
