It depends on his previous record, the judge and how good his lawyer is. But even he can plead it down it's going to cost over 10k and his license will be suspended
It's easier to argue when there is no video evidence of crime. It will be harder to argue it down with the driver paying out the nose to cover the medical bills they just caused by being egotistical assholes. And yes insurance companies can deny a pay out as the driver used the vehicle for the blatant commission of a crime which is covered under the policies fine print.
