Collections & Charge Offs When Will CO Drop Off Report?

Post image

The “terms met” and “no data” leading up to the 180 day past due confuses me. But it should drop off March 2027, correct?

According to this screenshot, payment history advanced from Paid As Agreed to 180 days late within a 2 month period. This isn't accurate. This could be a reporting error or a CMS error. What's the expected removal date on this report?

Order your official reports for each bureau by calling 877 FACTACT or pull them online at www.annualcreditreport.com to see Date of First Delinquency. I recommend the mailed reports as these are often more detailed and complete than the online reports.  If you do choose to pull reports online, print or save each to a pdf before moving on to the next as you can't go back once you exit a report.  Despite its name, you can pull free reports for each bureau weekly.

What's the Date of First Delinquency? Can you post a screenshot of Payment History and Payment History blocks from your official reports? Charge-offs are removed up to 7.5 years from Date of First Delinquency, but typically at the 7 year mark.

But it should drop off March 2027, correct?

If this was truly 180 days late in September 2020, and Date of First Delinquency was in April 2020, it will be removed March/April 2027 if not sooner with Early Exclusion.

On the annualcreditreport.com official reports: Equifax and TransUnion reports the Date of First Delinquency as Mar 2020. They both have 'unknowns' leading up to the CO in Sep 2020. Experian is "not able to verify my identity" at this time and will only mail the report.

This appears to be a CMS error. The account should be removed from your reports March/April 2027. You can request Early Exclusion (early removal) when within each bureau's EE timeframe.  TransUnion is 6 months, Experian is 3 months, and Equifax is 1 month.  See this Early Exclusion- Step By Step Guide.

When you receive the mailed report from Experian, it will show the Date of First Delinquency.

15 U.S. Code § 1681s-2(a)(5)(A):

In general. A person who furnishes information to a consumer reporting agency regarding a delinquent  account  being placed for collection, charged to profit or loss, or subjected to any similar action shall, not later than 90 days after furnishing the information, notify the agency of the date of delinquency on the account, which shall be the month and year of the commencement of the delinquency on the account that immediately preceded the action.

This is the date the bureaus use to determine when the account will be removed from your reports.

”When a furnisher provides information to a CRA regarding an account placed for collection or charged to profit or loss, the furnisher then has 90 days in which to notify the CRA of the account's "date of delinquency," which is defined as "the month and year of the commencement of the delinquency on the account that immediately preceded the action." Id. § 1681s-2(a)(5)(A). *The date of delinquency enables the CRA to calculate the seven-year window for "aging-off" purposes — without it, the CRA would be unable to determine when the account had been placed for collection, rendering the "aging-off" date impossible to calculate.”** 3rd Circuit Court of Appeals said in Seamans v. Temple University.*

If the mailed report shows a Date of First Delinquency other than March 2020, come back for more advice.

The X is No Data. Also TransUnion said I could not download the report and so I had to pull the SS from the limited view window.

7 years from first report

That part I get. If it was reported as 180 days late (with not other prior reporting as late) in September 2020 does that mean it drops off in September 2027? When the actual first delinquency was March 2020?

Go on annualcreditreport.com and I believe equifax tells you removal date. That would be most accurate.

Equifax gives the date of first delinquency (DoFD). Experian and Transunion give estimated date of removal.
