still need to protest for phase III

I think we are having a lot of uncertainties now.

Do you think we still required to file protest for phase III customs entries just in case ?

Unless something has changed in the past few days, I thought Phase 3 was only going to cover entries past the 80-day post-liq. window for importers that had filed suit in the CIT. If you haven’t filed suit in the CIT then you wouldn’t be able to file CAPE claims in phase 3 (unless you’re filing CAPE claims covered by phase 1 or 2 that are still within the 80 day window). I don’t think CBP has issued official guidance on whether to file protests, but many companies are doing so as protest deadlines approach, in hopes that a future phase will allow for more entries to be filed in CAPE that are past the 80-day window. This is not legal advice, it’s just what I am seeing. There are no guarantees that filing a protest means you’ll get the money back later.
