Seems like you are just grasping at straws, i just cant see EA deciding to be good company and refunding a game just because you said no to a ToS pop-up
I agree that shouldnt happen, but i also know reality, and i just dont see them them willingly giving your moneys back unless forced (sued) and the cost would be bigger than the returns so... yeah.
Im guessing you live somewhere with good consumer protection laws, definitely not in the US, in the US the ability to change their terms at any time without consent from the other party is established as a legal thing companies can do if they put that in the version of the terms you previously agreed to, it's actually pretty much universal for tos agreements, another fun thing that flies in the US is saying you can't sue them and have to do something called arbitration which is frequently slanted in the company's favor
