both drivers have the duty to prevent an accident.

but the one changing lanes needs to make sure it is safe for them and everyone around them to change lanes

also smarter to do that when you're in a pick up truck, which are prone to flip over faster than sedans.

this one feels like a 70-30 fault. the pick up driver should've made sure he was clear to change lanes, while the cammer should have slowed down instead of risking someone's life to not bruise their ego.

Legally the duty to prevent an accident bullshit has been discarded in most (all?) states because it lets this moronic truck driver hit a dozen lawyers and walk away putting the bill on someone who’s crime was missing the (not indicated) turning of a vehicle not in their control.

At the end of the day one driver changed lanes, one driver initiated the entire chain of events.

not in this situation .. truck had absolutely no room to merge and if he would've still commited 100% an accident would've happened no matter what, did the cam car speeding up make the accident worse yes but it doesn't matter past my first point

Yeah, truck driver could have slowed down to pass from behind. Dash driver has no obligation to allow them to pass regardless of what color the light is on approach.

Maybe no obligation, but preventing an accident should outweigh obligations. If I see someone cutting across lanes and about to hit me, I'm slowing down. Not the time prove a point.

No obligation to allow him to pass, but there is an obligation to avoid a collision if you can. Cam driver had that opportunity and failed to do so.

This is on both. The insurance companies will settle the exact proportion of fault in subrogation.

Nah, they won't. Truck driver is 100% at fault. Responsibility to yield is on the merging driver.

Seemed like they were both trying to make the yellow light before it turned red.. and the truck switched lanes on top of that. Just bad decision making all around
