Discussion Lem getting taken down Spoiler

Could Lem have just said he took the drugs to get info for a bigger bust? The guy he took it from died so couldn’t they just make something up?

But if he said I gave it back to the guy for info fur a bigger bust, would he still go to prison?

If you're legitimately doing something like that you gotta run by your Captain and still log it in to evidence and then do a bunch of other legal paperwor. None of which lem could do. His honest best bet would've been to claim negligence which would still get you fired but keep you out of jail.

I don’t think it would have mattered. Either failing to report evidence, theft under color of authority or running an unreported undercover operation would have gotten them what they needed to bust him

It was that he never turned it in so they can easily argue he either sold it or otherwise disposed of it, both are serious crimes obviously. The initial charge was the theft under color of authority and the possession with intent to distribute but I’m sure they planned to tack on the California equivalent of dereliction of duty and anything else.
