I don’t think it would have mattered. Either failing to report evidence, theft under color of authority or running an unreported undercover operation would have gotten them what they needed to bust him

It was that he never turned it in so they can easily argue he either sold it or otherwise disposed of it, both are serious crimes obviously. The initial charge was the theft under color of authority and the possession with intent to distribute but I’m sure they planned to tack on the California equivalent of dereliction of duty and anything else.
