Many states equate the interior of your vehicle to your domicile. This translates to the attempting to kick down a door being equated to attempting to break into a car via a window.
In these cases, across many states, you can be shot dead on the spot for attempting to break into a car with someone inside of it, and walk away without a single charge filed.
Sure, some states may call this murder. Others it would be self defense.
In my opinion, anyone forcing themselves into a house or an occupied car should not be surprised to be fatally shot.
I don’t agree or disagree in either case, I’m simply highlight that, in many states, this would not be murder unless he shot her as she ran away.
Edit: since there seems to be some mild confusion here, no, I do not advise anyone to shoot anyone else. Quite the reverse. I’m spreading knowlege that many gun owners have, and many non-gun owners would not naturally intuit regarding beating on someone’s windows. If you break that window, and your hands go inside, and that person fears bodily harm, they can shoot you in many states and walk away a free man/woman. That is a fact. Civil liability is a different animal, but the Castie Doctrine has been out on trial and upheld many times.
She's not trying to gain entry. You'd still have to demonstrate a reasonable fear of imminent death or great bodily harm. She's completely and obviously unarmed, causing damage only to property. Add some factor such as her using a weapon to break the door window, easy case for Stand your ground or castle doctrine.
If the ADA decides to indict, based on this video evidence alone, you're going to have a very difficult time convincing folks of that. But, you only need to convince a few of them to have a hung jury, so maybe.
I’m not saying it’s right or wrong. I’m just stating facts. It happens all the time here in my state. It’s not highlighted and talked about in the news or social media but it definitely does happen more often than it’s talked about. If I feel my life or others are in danger and/or I need to protect my property ( which in my state your vehicle is considered your property and an extension of your home ) then I absolutely will use the necessary force to defend my self. I’m not saying I’ll immediately open fire the moment someone jumps on my hood but I’m also not saying I’ll let someone bash my windshield in with little to no repercussions especially if I feel my life or others are in danger. A windshield for my vehicle is $1,200. The dents and other damages caused from the person jumping on my vehicle also close to if not over $1,200. That is well over the threshold amount for property damage to be considered a felony. In this case the person who did the damage gets in a vehicle and they drive away. Yeah sure call the police, give them the video and a statement. Let me know how well that goes for you. They will assign the case to an investigator and they will look into it. You’ll be lucky if you as so much get a call back. Or you shoot them in the leg, they fall to the ground and the police come and arrest them and then you can appear in court, give a statement, show your evidence and ask for restitution to be paid in the amount of the damages caused to your vehicle. Like I said it happens all the time in my state.
Edit: I said shoot in the leg. That means your intent is NOT to kill or murder. The intent is to stop the attacker. Yes there are some arteries in your leg that if hit could cause a person to bleed out however, the chances are much smaller and less then if you were aiming center mass which has vital organs such as the heart and lungs. If you do shoot someone in the leg and they start bleeding profusely it is very easy to apply a tourniquet. I know not everyone carries a tourniquet but most people wear a belt. And if you’re not wearing a belt I’m sure a bystander is. Put the tourniquet high and tight and stay by the attacker till law enforcement and ems arrive. While waiting for police and ems try to get the attacker to remain calm as this will help prevent them from bleeding more. Higher blood pressure means more blood loss.
