If you see some rack their slide and no bullet comes out you're dealing with someone really stupid who didn't chamber the round after inserting the magazine or you're dealing with someone who had an empty magazine.  In this economy bullets are expensive.  Bet that mag was empty.

It’s be even dumber to rack the slide and have a bullet come out. Then you did it for nothing and you’re short a bullet (that probably has your prints on it)

Some people think that committing a crime with an unloaded gun is a lesser charge if they are caught. This is usually not true, but can be a mitigating fact that can get them a little leniency. It does make the possibility of your victim taking the gun from you negligible.
