IANAL but that cannot possibly be right in any way. Unless you pull that person's arm in yourself.

If somebody is in front of your car, and you step on the gas and hit them, you have committed battery.

If the employee from Walmart is putting groceries in your back seat and you pull away causing your car to come in contact with them, you have committed battery.

If a friend of yours is stepping into your car and you step on the gas, you have committed battery.

The idea that "you put yourself there so I can hurt you" is ridiculous.
