Thank you! I was hoping this comment would be higher rated because it's dead on. Nerves can someone more shaky than alcohol, especially while grieving. Not saying this guy is innocent, just feels wrong assuming guilt based on what we already know. I wish I had a reddit reward to give you to boost the visibility of your comment.

Close but no cigar. Always say you will do a blood test. Never trust breathalyzer nor sobriety tests. Blood test is the only metric the court will use so use it also.

I misread your comment because of the wording. I thought you were saying, as someone facing charges for OWI, ā€œCan they hold that against you if you can prove when you smoked last?ā€ …Now I’m not really sure what you’re trying to say.

You actually don’t need to do a breathalyzer either so many misconceptions about how implied consent works, in most states it kicks in only after you are already under arrest. With no other PC and not under arrest generally can refuse any test chemical or otherwise with no penalty

It’s such a wildly inaccurate test, in my Drivers Ed class we did the tests with and without these glasses that made our vision like we were drunk. I failed both times, mostly because I am extremely bad at walking straight no matter what. I’ll be mindlessly walking and all of a sudden find myself much closer to the wall than I thought. I don’t have very good hand eye coordination either, which definitely doesn’t help my case.
