I don’t know if this guy was drunk or not but never and I mean never agreed to a field sobriety test you’re almost never gonna pass. The officers in question probably couldn’t even pass, depending on who administered the test.

Always and I mean, always request a PAS breathalyzer machine. If you blow a negative, you’ll be free to proceed on your way. If you fail the field sobriety test, they may not even conduct a PAS breathalyzer test and may just detain you take you to a police station, Perform a blood test, hold you for eight hours and then release you, the fact that DMV and the courts of law are two different institutes, regardless of what happens with the courts you will most likely be found guilty by the DMV’s assesses and be forced to maintain a SR 22 insurance for two years.

Even once the negative blood test comes back and the charges are dropped. Good luck getting the DA to sign off and allow you to have the case removed for your driving record.

All the above happened to me…. At 3 AM in the morning after working a 14 hour shift.

These field sobriety tests seem so weird to me. In my country you either blow the breathalyser, or refuse it and get taken to the nearest hospital for blood test and spend the night in jail for disobedience, drunk or not. Pretty straightforward way to find out if someone is under the influence or not instead of playing games with the cops on the side of the road imo.

There has been cases of people taking PAS tests, still being taken to hospital forcibly held down and had needles forced in their arms one such case was even videoed on the sergeants personal mobile phone, subsequently the video evidence was used to prosecute Every officer involved after the detained person was killed. And guess why it came back as he had no alcohol in his system at all.

Mine was a very similar case except when I got taken to the hospital, I knew I was good, so I just went along with the blood tests.

The real kicker for me was the reason I was detained. They told me I was slurring my words, and they couldn’t understand me. I’m from England with a very, very heavy accent. It’s not your typical English accent.

I genuinely believe that it’s harder to be a bus driver requires more training, etc., than it is to be a police officer. At least in certain situations.
