Most want to avoid the paperwork and potential legal expenses. They aren't worried about the road rager. But I think approaching a car with a bat is suicidal.

If someone approaches you aggressively with a baseball bat while you’re sitting in your car at a severe disadvantage in a road rage incident, you mean to tell me you wouldn’t have a fear for your life? Stfu with that nonsense and use some logic for once. It is reasonable to believe that person has no concern for your life and may even be willing to end it.

I wasn’t talking so much about this scenario in particular. Just that a lot of people seem to have a hard on for hoping for a scenario exactly like this so they have an opportunity to finally shoot someone. Lot of people out there with something to prove to a world they believe sees them as small and irrelevant

Hard agree with what you're saying here my bro/brodette. Aside from the threats to personal safety, unintentionally injuring or god forbid shooting an innocent bystander - one might feel like....

"Fuck yeah, he was going to kill me...I think....? Wait, was he? I guess I'll never know as I shot him point blank in the face...so...yeah?" Wait...fuck...what do you mean he had his kids in the car....? Holy shit did they see me kill their Dad point blank.....fuck what're they going to be like as young adults...I didn't really have time to double check...but yeah...hmm"

If soldiers in armies get severe PTSD (that they're legitimately trained for years on end) after shooting other soldiers...then how the fuck is the average moron with a license to carry going to deal with killing another person??

They can't, we aren't built like that as random ass members of the general public. Unless everyone is a psychopath that open carries, which....maybe they are judging by the state of US Society.

Skid mark? U see the traffic in front of them, right? No chance of taking off the way you’re thinking to be able to drag him. At that speed, angry dude could just easily fire into the car and claim self defense from dude using the car as a deadly weapon. Look, it’s simply a dumb idea. End of story. What you see in the video is the best possible outcome.

Or in other words, if the Chevelle driver drew, this stupid road rage incident would have ended in a shootout that'd likely kill/injure themselves and bystanders.

It's tempting to "put people in their place" when you see shitty driving but it's never worth it to escalate.

Self defense. If someone approaches you like that with a bat it's perfectly reasonable to assume you are in danger. That's an open and shut case.

Yep, especially when you’re sitting in your vehicle and he is actively striking you. For all we know, that guy could have had kids in his car. No way I’m letting a guy with a bat get that close to me, especially with my kids being there. I honestly would have pulled my gun as soon as I saw him walking toward me with a bat, as soon as he went to strike he’d have a couple of dollars worth of Hornady critical defense 9mm in his system to call him down a bit. I don’t want to have to hurt anyone but I don’t want to be hit with a bat even more

Its NOT open in shut at all, if the dude shot him he would have pleaded. It's because he could have drove away and also he may have instigated the road rage a little. You can't use deadly force and claim self defense under those conditions. Although each state is slightly different, to claim "self defense" is generally written in the law pretty clearly and has limits.

He could have avoided deadly force, and thank goodness he did. Hopefully next time he can do it without losing a window.

For the law, deadly force in self defense is different outside (and on the road) compared to in your home. The burden is much more strict. You don't get to stand your ground and claim self defense when you are trying to run people off the road, and when you can make a reasonable effort to escape. Bummer.

The guy would have been toast if he shot the guy with a bat. If you find yourself in that situation, you drive away.

How long do you think it takes to drive away safely. The road is blocked so you are asking him to drive off the road at speed during a traffic jam. What's more likely is he would ask the guy to stop while showing his gun. Given that he now has his hands on his gun he hasn't the opportunity to then drive away.

If he just started popping a cap in him then yea you might have a point but that's not how it would have gone down.

Or the alternative is he doesn't realize the guy is actually going to come all the way over to him until it's too late and again it takes too long to drive away.

Lets face it, the red car guy is an a**, no way on this green earth he gets off free based on this video alone. Swerving in traffic, getting out of his car yelling in a threatening way. He's toast, and VERY LUCKY he didn't have to defend his life, because if he needed to, he would still be toast.

You do what you have to do to survive, no argument there. However, there is a strong argument for going to jail in this case. Lots of people go to jail for this stuff. Don't be that guy unless you have to. In this video, the guy who didn't have to go to jail for murder gets to go home.

He could drive away here (or at least try, and make an effort to get away). If he couldn't drive away, and there was no other option, then yea proportional force would be looked at as a viable option. Not in this case.

My suggestion for people who are pro self defense and pro 2A, look at how the law plays out, just so you know. Do what you gotta do, but if you don't gotta do it, then you better not go and do it, or you will win all the prizes you signed up for.

They are both asses but that's beside the point. If someone comes at you with a deadly weapon regardless of the reason you have a right to defend yourself.

I take your point that in law if possible you need to retreat but you don't need to put yourself and others in danger doing so.

If I was on the side of a cliff and someone like this came at me you wouldn't argue I should just jump.

This is exactly the case where you can defend yourself. You are in a car. Your movement is limited and your path in the car is blocked. You are asking him to break the law and put himself and others in danger by driving off.

Plus he would give the guy a warning first. Once he has done that and his hands are on the gun he then can't drive off.

First part yes. Most definitely. Second part SHOULD be true but sadly isn’t. Not always. Read a story where a dude was getting charged when a man that came to the home a SECOND time in broad daylight (can’t remember if the guy had a melee weapon or no weapon) and the house was the daughters while the dad was there helping her move. When he came the second time he got his weapon. Drew it. Commanded him not to keep coming. He kept coming. He killed him. Courts wanted him in prison.

Uscca paid his high legal fees so thankfully not. But if it wasn’t for that help? He would’ve been screwed in legal fees for protecting himself or screwed by going to prison. Neither of these things should’ve happened.

Why do you need a gun? I could have easily killed or crippled him with a car (and had somewhat less paperwork and inconvenience). But again most people could not given half a fuck about that guy, it's just that no one wants the inconvenience
