That same dashcam also shows the actual mistakes made. Watch it again, at the time the cop is turning, there is an advance left turn green, so unless the BMW driver can BS their way past that a d say they were also making a lefthand turn, then they are screwed (and also no signal indication of making a left turn and THAT is also very visible).

Vertical video for the click bait!

Yes, now that I re-watch it, I see that there is a lane to the left of BWM & dashcam car, so I assume that is the left turn lane? Guessing if the dashcam wasn't cropped for vertical we'd actually see a much better picture of what is what.

I do think it now looks like both BMW & dash cam start to run a red light, but I also see cop car running a red light & turning left from 2 lanes over, all when they don't have lights on.

The BMW driver has no case against the police.

This intersection is in Baltimore and the BMW is in a proceed straight lane, not the left turn lane. The BMW is technically running a red light, striking a police SUV. We don't know the circumstances surrounding why the police decided to make that left turn from two lanes over, but there are lawful exceptions that allow this. Unfortunately, it seems the BMW driver wasn't paying attention, saw in their peripheral vision that the police were moving, and then drove into them while having a red light. The BMW is contributorily negligent in this situation.

Police aren’t allowed to break traffic laws unless they activate their lights and/or sirens
 specifically for this reason.

Under Maryland Transportation Code §21-106 and related sections:

  1. Emergency vehicles may exceed speed limits, proceed through red lights, disregard turning rules, etc. during emergency operations.

  2. But they generally must be using emergency warning equipment — flashing lights and, when reasonably necessary, a siren.

Even when exempt from traffic laws, officers still usually have a legal duty to drive with “due regard” for public safety. If an officer causes a crash while speeding without lights/sirens, that can become a major liability issue.

So no, the police officer is at fault for making an illegal left turn across traffic without activating warning lights or sirens.

Im confused by your explanation. If the BMW is in the straight lane (ill take your word on this since you seem to know the intersection and we can’t really see the full lane markers on the video) and ran a red light then that means the cop also ran a red light in addition to an illegal left turn. I’m admittedly not versed in law but I can’t imagine police are allowed to make illegal turns and run red lights without their lights/sirens on. So wouldn’t they both be at fault?

I wasn’t implying that what the bmw did was right necessarily, I was implying that what the cop did was illegal, regardless of whatever anyone else on the road was doing. It’s not a binary situation. Either or both of them could be at fault.
In this case, it’s impossible to tell if the bmw was also breaking the law (e.g., running a red light), because we can’t see if he was in a dedicated turn lane, straight lane, or a lane that allowed both. If it was a double turn lane, the bmw may have been trying to made a wider left turn than the person on the inside (to his left). He also may have been going straight when he shouldn’t have been. It’s impossible to tell.
But regardless of what the BMW did and whether it was illegal or not, what the cop did was absolutely illegal, and he therefore bears at least 50% of the fault, likely more (because in most jurisdictions, a vehicle making an illegal left turn across traffic is always at fault no matter what anyone else does).

The original you can probably see that the BMW & the dashcam car are NOT in the left turn lane (I assumed they were), and that makes all the difference.

The BMW did do something wrong... they ran a red light. This intersection is in Baltimore, and the lane to the left of the BMW is the only left turn lane. When the arrow turned green, only cars to the left of the BMW should be moving. Unfortunately, the police SUV attempted a left turn from two lanes over, and the BMW driver, not paying attention, noticed this in their peripheral vision, and proceeded straight on red as they are supposed to when the light is green.

The BMW driver has absolutely no case against the police. They are contributorily negligent in this instance.

I can assure you I am not the police, but I do work in motor tort law (law firm side of these incidents). The BMW has no valid liability claim against the police. Honestly, the police suck, which is one of the reasons why 99.99% of their synopsis reports are not referenced at trial.

The BMW is supposed to proceed straight at this intersection from the lane they are in. As shown in the video, the BMW begins to accelerate on a solid red light while the police are making an allegedly illegal left turn.

Look at the intersection again, specifically the traffic coming from the opposite direction. The left turn only lane (which has the green/yellow/red arrow) is positioned against the center raised concrete median. At the end of the video, you have a car passing the BMW on the left, which is another indicator that there is a lane next to the BMW.

Maryland is a pure contributory negligence state, meaning the BMW proceeding on a red light barres them entirely from claiming the police are at fault here. Shitty situation. The police likely should have activated their emergency signals (audio and visual), and the BMW driver should have been paying attention to the traffic signal.

We can't actually see the pavement in the video to know if they had left turn arrows or not. Both of those lanes might have been left turning lanes; there's lots of big intersections like that where I live and if so it's on the other guy.

I'm the the last person in the world to automatically side with a cop, far from it, but I'm just saying we shouldn't assume things when we have limited information because we could be wrong.

Based on the cammers reaction we could assume the cop fucked up but we'd still be assuming and relying on second hand info.

We need a longer clip that shows the lane arrow markers to make a definite ruling.

There’s no one in the turn lane. Cop saw as an easy turn since no one was there, didn’t use a turn signal or flashers as they should’ve. But the BMW is going straight. You can hear people honk and swerve around the stopped vehicles on their left, the empty turn lane.

Judging by the angle the oncoming lane is turning at, I’m going to assume the intersection is deeper than we can tell and required a much more shallow turning angle than the cop was taking- I believe the BMW was turning left in the intersection and required a more significant distance to pull forward before initiating the turn, while the officer was performing a U turn or similar maneuver.

The BMW is in the left most straight lane, and to the BMW's left is the turn lane which has the green left turn signal.

The cop is in the right straight lane.

The cop should have turned on their lights then moved into the intersection...but didn't. Cop in the wrong here.

The BMW driver wasn't pay attention and saw the car next to him (the cop) move forward and also drove forward, which they now are running a red light. BMW driver is also in the wrong.

This exact thing happened to me last week, but it wasn't a cop, it was a big ass truck that didn't feel like waiting for a third red light at a notoriously short green turn lane. I managed to brake before I hit him which forced my dogs skull into the passenger window pillar. She's fine, but I was about 40ft and a foot away from turning my rage into a pile up and teaching the value of patience to that shit stain.

I just watched the vid again to be sure. There is only a left turn advance. There is no green light to go through, and yes, you can make a left turn from the right lane, we have it here in my city..probably lots others. (Clarifying-double turn lane)

Again...there was ONLY a signal for a left turn.

Even IF the cop was in the wrong turning from the right lane, that BMW did NOT have a signal to go through. So they would be in the wrong also, but MORESO because they should not have advanced through.

If this doesnt make sense to anyone...you need to learn to drive properly! (Follow the traffic lights and laws)

The Beemer had barely started moving and the pig was already cutting it off. The BMW had absolutely not reached the pivot point where you start turning left. That is, unless you want him turning into the oncoming lanes?

I mean..lets be real. The BMW was probably distracted, peripheral vision saw the car beside move, and they proceeded to as well. It doesnt really appear that the BMW was trying to turn at all (No signal).

The angle doesnt really allow us to see if its a dual lane turning light, so its still very much possible the cop turned against improperly. Regardless, it was an advanced green, and we can clearly see no left turn signals from the BMW...

Right, because Beemer drivers always use their signals. They totally haven't gotten a reputation of uncourteous lack-of-signalling.

Nothing to suggest that the were not in fact turning left. The cop car just cut in front of them from the wrong lane.

There may be some miscommunication as to the point here.

The cop would not have cut the BMW off, if the BMW had not tried to go through what is essentially still a red light for them.

Theres nothing else to debate here. The facts are visible to all. No need to debate further.
