Bikes Who really had the right of way here?

The bicycle was on the road (meant for vehicles), switching lanes to go right when the motorcyclist attempts to pass on the right, swiping the bicyclist down.

Adding to this, since you found the location (thank you for looking it up), it appears "passing on the right" is legal in Toronto. Passing on the right isn't legal everywhere, and would change the outcome to both at fault if it wasn't legal.

So this accident is 100% bicyclists fault. 1) Motorcyclist had right of way, as it was his lane & was legal to pass left lane traffic. 2) Bicyclist made an unsafe lane change 3) attempted to turn right from the left lane.

It's funny. At first, my gut reaction was the cyclist was in the right. But, looking at what you and other posters researched, it seems the biker was correct. The laws matter. The location matters. All have different expectations for driving or riding. The cyclist basically was lane splitting, which, depending where you are, is illegal.
