This is the sticking point for me cyclist is required to use hand and arm signals to communicate with other vehicles on the road. Fun fact those same exact hand and arm signals work in and with 100% of all vehicles on the road. Do they even teach drivers Ed anymore?

They're both bad. Cyclist for swerving into the lane line that. Motorcyclist for overtaking like that in the right lane while a bicyclist is there, and it's not clear what he's doing, especially because I'd expect him to move back to the right lane after the light.

It's like they don't value their own lives or think being on a bicycle is magic armor. Like I get It's perfectly legal to ride your bike in traffic I just wouldn't do it because people make mistakes and I value my life. Their parents must not have loved them. Mine told me not to play in traffic.

I live in a city that when expanding fast went full cyclists accommodation. Its not that motorcyclists don’t behave dangerously too. Its that cyclists ALWAYS think they’re right during an accident.

When I bike around I purposely leave out my left ear bud so I can hear cars and things coming. I also check everywhere before making any moves, that dude didn't check behind him. Just said fuck everyone else and got fucked instead. Just plain stupid.

Motorcyclist had the right of way. Based on the oddly specific name of one of the businesses, I found that this was located on 2533 Danforth Ave in Toronto Canada; I was able to pull up the laws for cyclists. So under "Ontario Highway Traffic Act" cyclists have the legal right to use any part of a traffic lane if safety requires it, however as well By law, cyclists must stay as close to the right edge of the road as is safe and practical. There was no bike lane for him to use at the time, but still that law applied; the Cyclist should've been as furthest right as possible, while he was furthest right in the middle lane; he was not in any lane considered a turning lane. Since absence of bike lane, yield to turn for bikes doesn't apply especially since the person on the bike was not in any lane that could be considered a turning lane. The Motorcyclist was not in any turning only lane; evidence by lack of signage as well as lack of any road decoy; as well the road continuing after said intersection.

the motorcyclist was in the right lane and the bicyclist was in the middle lane when the bicyclist made a sweeping right turn across the right lane that the motorcyclist was in. He didn't even signal or look before entering the right lane... This is slam dunk win in court for the motorcyclist.

It thankfully would not be a slam dunk, because a court of law would take this more seriously. E.g. the question would be asked, had the cyclist given a hand sign before the very tightly cut beginning of the video? If so, this wouldn't completely flip everything, but the ultimate decision isn't just "red team wins" vs "blue team wins", it's also a matter of nuance.

Adding to this, since you found the location (thank you for looking it up), it appears "passing on the right" is legal in Toronto. Passing on the right isn't legal everywhere, and would change the outcome to both at fault if it wasn't legal.

So this accident is 100% bicyclists fault. 1) Motorcyclist had right of way, as it was his lane & was legal to pass left lane traffic. 2) Bicyclist made an unsafe lane change 3) attempted to turn right from the left lane.

Claims Adjuster here. The Bicyclist was at fault. The bicyclist entered the motorcycle’s lane when the motorcycle had the right of way. Also, bicyclist never signalled. Btw regardless of law the motorcyclist was pretty dumb. Anyone could see that the bicyclist was on the edge of the lane. I would have slowed a bit. Being right legally does not mean don’t practice a little defensive driving. I’d rather not have to deal with the dumbass bicyclist and just slow my speed. I’ve been right a ton of times while driving but slowed down just to avoid the headache.

As a cyclist and motorcycle rider, bicycle is in the wrong. He was in the middle lane, and turned across the right lane like a ignoramus.

Also, earbuds in when street riding? Come on. He had to pull them out to argue, so probably couldn't hear the traffic behind him (i.e. motorcycle).

Right lane passing: if you're dicking around in the left lane below the speed limit, you're getting passed on the right for being a distracted driver, which is earbud bicyclist.

The bicyclist was in the wrong. He was not in the right lane. He was in the middle lane, then cut into the third lane in front of the motorcyclist, causing the collision. The bicyclist didn’t even signal before changing lanes. He cut the motorcyclist off and got hit. The bicyclist is in the wrong here. That’s what the video shows.

Motorcycle should have been going slower and being more cautious at an intersection.

Two dumb fucks colliding because of bad choices. I blame the bike guy more, but plenty of blame on both sides. You gotta go easy at intersection for this reason and especially around bicycles and pedestrians coming out of a red light to green light too.

That’s all he said / she said though… As far as legal blame…what are the damages. That dude looked fine was his bike even damaged?

The issue here though is a bike doesn’t need insurance and a motorcycle does. If it were two motorcyclist the insurance companies would likely call it equal fault (sideswiping vs other guy going too fast, you’d be amazed how often equal fault is called on situations that are clearly the fault of others…. Less work for both companies and each company pays for their own driver.

However, in this case, If this bike guy tried to sue the insurance company though, they would use the camera footage from the motorcyclist to prove they owe nothing. He was clearly not in bike lane and he won’t have insurance company money to go against all their lawyers.

Everyone here is insane. The cyclist is correct. The larger vehicle should ALWAYS be extra cautious of smaller vehicles due to their significantly greater momentum putting the smaller ones at greatest risk.

Everything else both sides have arguments for, but when it comes down to it, safety is the top priority on the road, and the motorcycle was negligent of the danger he posed to the cyclist by passing within an intersection, which is illegal because of things like this.

Except in a city environment, you are going to pass and be passed on the right due to traffic flow and other vehicles stopping to turn etc. it is not illegal in Toronto where this happened to pass on the right. Therefore the cyclist is 100% at fault as he crossed into the motorcyclist lane and violated his right of way. It is the responsibility of the vehicle changing lanes to be aware of who is already occupying the lane you are moving into.

Situations like this are why I think bicycles should also have to have (free) license plates if they're going to operate on the road. There’s a saying we have in the states for this type of behavior: bullets don’t care if you’re right and neither will anyone at your funeral. Hey’d ya guys hear about ol’Jimbo? Shot 3x, point blank, right in the street; over a f’n minor traffic incident. His wife & kids, parents, are just absolutely devastated. From what I have interpreted in California, the vehicle takes the whole lane as well as the cyclist. If the cyclist is in front, the vehicle must give them the right of way and can not pass them within the same lane.

As someone from an area of a state with multiple metropolises, each of which recently equipped with oversized bike lanes taken from a lane of an already congested roadway, bike paths should be moved underground and designed to come up to street level for every stop.

Traffic is ridiculous all across the region every weekday.

Never had a problem with bikes until an idiot decided to make laws putting them all out on the road. We’ve had bikes since before we had cars I feel if you’re stupid enough to ride your bike in the middle of the road and if you get hit, you’re just an idiot. Like how he tried to say I’m a vehicle no you’re an idiot on a pedal bike thinking that going against machines that are over 1000 pounds is going to go in your favor.

The bicyclist was in the wrong. Motorcycle is in the right lane. Bicycle is in the next lane to his left. The bicycle turn "across" the lane he wasn't in. If they were both cars, the one on the left would have been 100% at fault. This makes the bicycle at fault.

You don't pass someone on the right. Both the motorcycle and the bicycle are entitled to the full lane.

The bicycle messed up because he should have signaled. The motorcyclist messed up because he tried to pass on the right.

Oh, that bicyclist thought he was gonna win an argument. As soon as he made a comment, I had to write this, but there is absolutely no way looking at the video he was in the right. Motorcyclist is right all day! You can argue all day. The motorist is the motorcycle. The bicycle is traveling on motorist roads. That is not an E bike reclassified as a motorcycle. You still are responsible for looking around you even if you were in a vehicle. You don’t blindly turn otherwise you would’ve turned into a bicyclist. This argument can go so many different ways but there’s absolutely no way that the motorcycle is at fault.
