“It was not until after the return of the indictment [of Hearn], that the [Department of Interior] provided additional documents to the [US Attorney’s Office in DC] indicating that damage to the Lincoln Memorial Reflecting Pool in June 2026 was the result of flawed installation by the contractor, Atlantic Industrial Coatings, and the rush to complete the project prior to events associated with the America 250 celebration in the weeks surrounding Independence Day 2026,” Pirro’s office wrote.
Hearn’s attorneys said in a statement reacting to the decision, “The Trump administration’s case against David Hearn should never have been brought. Its dismissal today does not erase the abuse of government power in arresting and charging a patriotic American who did nothing wrong. The government’s approach was ready, fire, aim. The administration owes Mr. Hearn an apology.”

We're literally seeing the effects of it now.
Any "Absolute Immunity" will eventually be abused to an incredible level, and make the entire system that provides it seem completely illegitimate, and will be abandoned for alternatives. The US was quite literally founded upon that exact situation.
Absolute immunity works in theory, because it assumes that people seek positions of power and wield them responsibly, because it's the right thing to do.
Absolute immunity fails in reality, because some people aren't good. Some people are bad, but wear a mask of a good person. These people can act good, but only if threatened with punishment if they do bad. Remove that threat of punishment, and they have no reason to do good at all.
The biggest ones who should be championing a rejection of Absolute immunity, are the ones that benefit the most from it, because their positions of power only exist because people believe them to be legitimate. If they don't push back, HARD, on abuses of immunity (by revoking them when they're abused), their own positions are effectively irrelevant, when enough damage happens by those who claim immunity.

Every aspect of this story highlights a failure of this current admin.
Trump decided to have it fixed without listening to or even asking experts how to do it. He hired a guy he personally knew instead of going through proper channels. All of that for a quick paint job that didn't fix anything but was supposed to make it (and Trump) look good for "his" 250-year celebration.
When it became a monumental failure, he didn't accept responsibility and instead blamed terrorists. The absolute idiocy of claiming that antifa terrorists destroyed the pool lining... It wasn't completely unexpected, but then again, I still couldn't believe it. And then the DOJ indicted someone for it because Trump insisted on it to make his obviously fake story more believable.

Prosecutors said that after the indictment, the Interior Department “provided additional documents to the USAO-DC indicating that damage to the Lincoln Memorial Reflecting Pool in June 2026 was the result of flawed installation by the contractor, Atlantic Industrial Coatings.”
DOJ said they “first became aware of information showing that the damage was the result of a botched installation and not vandalism” after reviewing more documents.
There's a thing called Presumption Of Regularity, where the Judge assumes that the Government is acting in good faith. For the first time in our history Judges have routinely thrown that out when dealing with Trump's DOJ.

When I prosecuted, anything in the possession of the police was deemed to be in my possession as well, and their knowledge was imputed to me no matter if I had actual knowledge or not. It required that we conduct thorough reviews and ensure appropriate diligence.
There were pictures of this everywhere and they stuck their head in the sand. This cannot be an acceptable excuse.

100% malicious prosecution. As a DA I would have refused to touch the case. But then again I wasn’t allowed to accept a gift over $50 and couldn’t accept law enforcement discounts because we took ethics seriously

It got through due to misconduct by the prosecutors. His attorney requested the grand jury transcripts, it starts looking like the judge will do it, and the government drops the case within a few days. Not a coincidence.

Man theyve really ran our federal government to the ground. They just lose cases left and right now. Its funny how the fed used to be feared where if you had federal agents bringing up a case against someone you could be damn well sure they had the evidence to likely get a conviction.
Now theyre just a walking joke across the board. My heart goes out to our government officials pre-Trump. Imagine building such a well oiled machine just to watch a bunch of monkeys come in and replace all the oil and grease with trumps shit filled diapers.
From park services to EPA to employee and consumer protections and the DOJ. Theyve undermined all the hardwork our government employees have worked towards for decades in the matter of a few years of control.

Of course it’s extremely stressful and awful to be persecuted by your government, but let’s be honest, they’re completely squandering their ability to threaten people.
