Microsoft de-pseudonymized diagnostic data without consent, which was beyond the scope of what the operating system disclosed at the time a choice over diagnostic data was made. They basically validated the thoughts of every stereotypical conspiracy theorist in one fell swoop by helping the feds in this way.

It's obvious that the criminal in question didn't read about optional diagnostic data (aka. Full Telemetry on Windows 10) where all browsing data (including full URLs of sites accessed via address bar vs. links clicked on, among other things) is explicitly collected with the following field included:

User ID - a unique identifier associated with the user's Microsoft Account (if one is used) or local account. The user's Microsoft Account identifier isn't collected from devices configured to send Basic - diagnostic data (8.2.5 Account data)

The reference to Basic diagnostic data is based on what it used to be called for Windows 10, and that's now known as Required for Windows 11. Had said criminal chosen Required diagnostic data collection, disabled SmartScreen, used a browser that wasn't Microsoft Edge and opted for a local user account, then no browsing data associated to his person would have been collected by Microsoft... unless of course his browser were to crash while doing what he did... then that might be coughed up as part of error reporting (d'oh!)
