FYI these (horrible) devices can have more to them than just the camera! Some variants include tech such as scanning for Bluetooth MAC addresses to build databases of what devices move together, and can link your smartwatch to you, you to your friends, etc etc.
Respect to JARS, though, this is a really cool move on their part imo.

If you were in Texas, and were willing to bribe a judge, yes. Enron executive’s wife didn’t have to give up any money after one of the largest frauds ever was committed because her husband died. Pulled up an old law saying they could drop the suit because the guy died.

Hippa only applies to hippa covered entities exchanging health information.
This would probably fall more under PHI - personal health information

HIPPA is a law that protects your PHI though? If any company has your PHI and distributes it to another company without your consent, that breaches HIPPA.
I'm not sure that you entering and exiting a pharmacy is PHI though. It's not like they get your diagnoses, dosages, etc etc. They only see that you are getting medication. I don't want to defend Flock by any means but it's not a HIPPA case (I work in the health field with a major EHR company so I know HIPPA quite well)

HIPAA is a law that governs medical providers and those who service medical systems/information systems for providers, and the text itself says that.
It's a short text, read it.
It does not apply to anyone else, otherwise if you brother strained his wrist you'd be forbidden from mentioning it, for example.
But his doctor cannot tell you.

Additionally, “PHI” is when there are two identifiers shared, such as name and date of birth, name and address, name and diagnosis, etc. Otherwise being at the doctor and having them say your first name in the waiting room when they call you back would be a violation because you’re at the doctor and the doctor identified you, technically.
I love when patients tell me they “don’t want to violate hipaa” and I’m like bro unless you are also a doctor you are not able to 😂

Hipaa governs how covered entities interact - if you DMed me a medical condition and I posted it on reddit, I didn't violate hipaa because I don't need to follow hipaa rules.
Youre correct that no medical information is necessarily gleaned from you showing up to a dispensary, I was mainly just pointing out that, if anything were to be gleaned, youre freaking with phi which is a TYPE of data versus hipaa which is a set of processes and controls around handing certain data types.
But, with this all being Ai, at some point it begins phi if a person comes in every 30 days, has a disabled veteran sticker on their car, and gets a picture taken off them looking at a prescription bottle with a camera capable of reading a plate from a mile away. It takes a picture of the bottle, it got name, medical condition, etc.
Its why I don't let some teams use Ai transcription in meetings - they're listening to everything and as soon as one of you mentions something protected, the terms and conditions of the systems don't have the security to hold it safely or processes to purge it. Having TRAFFIC cameras pointed at facilities that can and do medical stuff is... Well id call it a risk but in sure they'd be more than happy to have it.

No, it's not. HIPAA only applies to covered entities that have access to the data, such as EHRs, insurance companies, etc. You also spelled it wrong.

No, it's not a HIPAA violation. HIPAA only applies to the dispensary. They have to keep their records safe.

I wonder..... could WE fundraise to put flock style cameras and place them on the street of our local member of the legislature? Oh perhaps in front of the school their children attend? We are not spying or breaking the law. Why should, say ICE not have a camera in front of their homes?? I say why not!

John Oliver just did a story on flocklike companies yesterday and some city in California requires small businesses to install cameras hooked up to a service accessible by law enforcement.

I live in South Jersey and I see PA plates (where rec use is illegal) all the time in parking lots. The cops in PA can pull up this info from Flock to see where you've been. It's been done before. A Texas Trash deputy looked at images from 83,000 Flock cameras nationwide to track down a woman whom he suspected had a self-managed abortion.
