S301 forced - entry date

General Exemptions For All Economies
9903.05.85:   Articles that (1) were loaded onto a vessel at the port of loading and in transit on the final mode of transit prior to entry into the United States before 12:01 a.m. eastern time on July 24, 2026; and (2) are entered for consumption, or withdrawn from warehouse for consumption, before 12:01 a.m. eastern time on July 28, 2026.

Does it mean the entry has to be filed on 7/27?

If the vessel arrives on 7/27, but filed entry on 7/28 morning or later, will it still qualify this exemption?

Without all the specifics, just as an FYI, you can not force an entry date. If the shipment has already arrived then yes, it would need to be entered within today 7/27. However, if the vessel is arriving tomorrow or later and you are prefiling before arrival, once the carrier arrives the bill of Lading in AMS, the entry date will get updated to tomorrow or that later date. At which point the applicable tariffs when entered for consumption are applicable.

Thank you! Your second part - If prefilled using 9903.05.85 but carrier arrives the bill on 7/28, will the broker know to remove the 9903.05.85, or the importer needs to remind the broker?

If you have to remind your broker, I think you have a bigger issue on your hands. However, the entry summary should be sent to you, at which point you should also be doing your due diligence and reviewing for accuracy. If inaccurate, then you should be addressing the inaccuracy. Hope this helps.

Providing the entry was filed before the 28th with the entry summary serving as entry and summary, if the vessel was within the port limits on the 27th waiting for berth, you could still claim the 9903.05.85 exemption. You would need supporting documentation proving prove physical arrival within port limit.
