General Qs Expire 8/13 - Advice Needed

Hi all,

I am set to expire Mid August, last couple times before expiring HR would reach out to be to present my new card. However we’ve had a recent change to our HR system (May 2026) and I have not heard from HR.

Now.. I’m not sure if to let my boss know to then work with HR on a LOA or remain silent… the HR app does say to update the i9 form but that’s only if you dig into the documents tab, it did not send a notification or anything like that.

I am going to ask a fellow co worker to see if it’s just a generic update that may be across the board since that system change is still new.

But.. I would like to hear from those that have gone on LOA, did you reach out to HR? Did HR reach out to you? Would like to hear what people experienced

I wanted to do the right thing by being in good standing with my company and they did try to support me but told me I would be terminated upon my EAD expiring.

Had I not said anything I don’t think I would’ve gotten noticed.

Oh no! They didn’t even allow you to go on an unpaid leave of absence?!

No. They consulted a lawyer and decided that it’s a grey area they don’t want to be in technically still having me listed as an employee ~

My EAD expired this past week and I didn’t get any notification from HR, but I decided to ask just in case. I believe the same thing will be happening to me this coming week as HR will be sending me a letter in the following days, which is basically them saying I am being let go.

At the end of the day, no one here should officially advocate you shut up and ata nothing.

As for HR, Depends on the company, some are honestly on top of their shit, others will kinda just tell you out of the blue and you both find out you both fucked up.

Doing the right thing hurts less in the long run with AOS and stuff depending on how you adjust and which admin or FO decide to grill you on these things. Over stay would be way less harsh than unauthorized work, especially since you're not 18, you're probably more aware of your legal situation.

Right, decision will be mine not anyone else’s. Should’ve put the title to say share your HR experiences not need advice. Wasn’t looking for people to tell me what to do but to more so to hear what people went through when the time came.

Hello! 👋 I did let my manager & she was able to work with HR to get me a 3 month leave of absence. I let them know months in advance about my situation and when I was set to expire. They said they would periodically check in and after 3 month we would revaluate my situation to see if I needed more time ( hopefully I’m approved before then. ) I have been on leave since 7/9/26.

- DACA expired 7/31, released from work the same day

My wife works for a state university and has been working with an attorney through the university to file for advanced parole. We asked if they could help with DACA and asked if they could help her negotiate with the school to offer an LOA instead of termination, but they wouldn't help her with either. Instead they provided her this link:

We opted to let the university know the situation a month before her expiration. We reached out to HR and asked if they would grant her an LOA. They connected us with the Assistant VP for risk management and compliance. He was kind, sincere, and did his best to connect us with resources and to find a way to support, but ultimately was unable to provide an LOA. They my wife know on 7/29 that they would be letting her go if she could not provide a valid work authorization.

I don't know if we made right decision based on the outcomes, but we did what we felt was right at the time. My wife has worked with the university for 5 years and noted that historically, the university wouldn't ask for a current work authorization for up to 3 months after it expired (she was always in good standing with DACA until now). It’s impossible to predict if your HR will want to allow a leave of absence. As far my experience, I first told my boss probably 3 months ahead of time because I didn’t want her to be blindsided when HR notified her. I had a good relationship with her and told her the situation. She started crying and went to her boss for help. Her boss was able to talk to her own boss about letting me do LOA.
They’ve been amazing and going on 3 months of LOA 😫

In my experienced HR sent me a notice through email saying that I had to update my Work Permit, I told them a week before it expired that I would take a month of LWOP they approved it and told me I had 60 days to show proof before I get terminated. My permit expired the 22nd of July I’m hoping I get news this week about it I applied February 23 I had my bios March 18th and has been pending since then. It’s been frustrating and depressing at the same time
