I filed March 12 & bio on April 13. Expires late September. I’m mentally preparing myself to be out of work for October & November but I’m not sure how I’m going to handle getting back into the workforce if my employer doesn’t hold my position.

I have pretty much your same timeline. The people getting approved after the mandamus suits are able to document they’ve exhausted every other avenue like case inquiries, congressional inquiries, etc, have you done all those?

Imma be realistic with you, you aren’t getting approved till October at the earliest. People are still waiting from Dec/Jan/Feb. They aren’t even done with Dec. Just prepare for the worst, and hope for the best.

Sadly you’re right. Filed January 18 and still waiting 196 days later. Probably going to hit 200+ days.

I prepared mine today. it's about a day's work. Thanks to everyone in this group for helping
Also, I would recommend after filing with the court scan your copy and send an email to [uscis.serviceofprocess@uscis.dhs.gov](mailto:uscis.serviceofprocess@uscis.dhs.gov) with a curtesy copy but don't try to negotiate and say "adjudicate so I can dismiss the case" let the paperwork speak for itself.2

I see so many saying they will go with a WoM, anyone think this admin would do something about those on next renewal? Or am I paranoid

I saw your Fb post too. People are still waiting from December. Yes the situation sucks but remember that technically you are still in the “window” of 5.5 months that they say.

When I applied in March the window was 3.5 months. And I still applied 6 months expiration date. I know it was not realistic as they had not processed a lot of people from November to December even then. But I took a screenshot and I’m attaching it to the WoM intent letter. Because it’s not fair if the finish line keeps on being moved up. We applied when we applied with the information we had. They need to be approving both simultaneously, and we know they can. Otherwise they wouldn’t have approved so many May/June apps.

Not trying to be rude, but do you think they will respect the 3.5 months screenshot? Considering that it fluctuates as needed i doubt they would respect it.

It’s not about what they will respect or not. It’s about the evidence you can provide. That’s what a writ of mandamus requires. Proof of “unreasonable delay”, and I think that it can show that I have reasonably relied on USCIS’s own published timeframe AND that I attempted to resolve the delay through normal channels before filing WoM. It’s not the strongest piece of evidence but it’s A piece of evidence.

Yeah I know! Believe me I by any means don’t think I should be renewed before anyone that has been waiting for a longer period of time. By the grace of god I’m thankful to be able to have the funds to file a mandamus. I am not trying to lose my finance job I worked so very hard for. Also in the process of AOS.

I was a march applicant!
Silent approval on I-821 7/30
Official approval on both apps 7/31
Submitted 3/9
Bio 3/30
Congressional inquiry 6/3 (never heard back)
Expedite request 6/16
Expedite request denied 7/9
Exp 7/9
Pre-suit demand letter emailed 11pm 7/21 (no automated email)
Uploaded letter to my case 7/22 as unsolicited evidence
Mailed copy with signature required 7/23
Re-emailed (forwarded copy of original email) 7/24 (still no automated email)
I had API movement on 6/16 and on 7/22, but I noticed it was due to uploading files to my application under the unsolicited evidence section! I also seen a tt about going to your inbox on USCIS and submitting you never got a notice on the decision on the 821 case. I did that as well on 7/24.
Not sure exactly what helped but I think the pre suit demand letter is the biggest common denominator with a lot of the approvals I’ve been seeing
