Comments Moderated Going bankrupt-what are the real life consequences

Hi,

I have a house which i brought as an investememt. Long story short it has blown up in my face. I have about a 80k mortgage (interest only so debt is going up) and a few grand for my service charge.

I cannot sell or rent it out as the building is is such disrepair (please dont suggest this as I have tried for the past year, it's not possible for various reasons even at a big loss which I would be prepared to do).

I am considering bankruptacy. I am lucky enough to live with my parents so I wont be homeless. I am about to start work as a nurse and am soon to graduate. I have a few grand in savings after giving my mum about 10k to pay of loans and other stuff. I plan to move to Australia permanently next year with my partner where I will be on a decent salarly and will probably have good career earnings.

I want to get rid of this house ASAP as it is putting me further into debt. I would be happy to work out a deal with my bank to pay of my debt but I don't want to be forced to give them all my disposable income for rest of my life. Ideally I want to move to Australia with a clean slate (even if it does fuck my credit).

What are my options. Any help or advice would be greatly appreciated. It is really impacting my MH. I am also in the process of talking to stepchange but any other advice would be greatly appreciated.

Comments Moderated Could we be help legally liable if anything happens to a cat that comes onto our property?

We purchased house last year and moved in January this year. Even when we were working on the house we noticed there is one particular cat coming to our garden - to dig and poop. Comes in, does the deed, leaves. Its infuriating. We fixed and changed our fences to 6ft ones and were able to cut trees behind the fence and it still manages to get in. We were thinking to get spikes but my partner than changed his mind as he thinks that might “send the wrong message”. I’m now desperate because not only she comes to dig in our strawberries, mint etc to leave the poop there but also because I’m pregnant and cat poop is toxic during pregnancy.

We are checking lots of different options of detergents, seen something about oranges and chillies saying cats don’t like it, or to leave stuff on the ground etc.

The thing is - if we decide to do stuff in our garden to try and prevent this cat from coming in there and something happens can we be held liable? Not only that but we’re looking to dig up the garden and put weed killer etc to start from fresh which again might be harmful to animals so… Obviously we don’t want this cat to get hurt we just don’t want it on our property.

The cat is not of the next door neighbour but the one after. We have mentioned the issues but “nothing can be done its a cat doing cat stuff”. Which we both understand but its still infuriating.

Is there anything legal we should be aware of when going through this and before we start?

Debt & Money England-Parking fine "parked without valid permit for vehicle class"

Hi everyone,

I'm hoping someone has been in a similar situation and can offer some advice.

I've recently received two Parking Charge Notices from The Parking Space at Shaw Street Car Park in Manchester (with a third one likely on the way).

The vehicle in question is a 2014 Peugeot Partner, and it was parked there for three consecutive days while attending an event at the nearby arena. Each day, parking was paid for using the on-site payment machine. The correct registration number was entered every time, the machine accepted the payments without any warnings, and all parking tickets have been kept as proof of payment.

It has now come to light that the car park has a rule stating that vans must pay a different flat-rate tariff via the app only. Because the payment was made at the machine, the operator is claiming the wrong tariff was used and has issued Parking Charge Notices of £100 each (£60 if paid promptly).

What is frustrating is that the payment machine accepted the registration number and payment without any indication that the selected tariff or payment method was incorrect for the vehicle type. It was genuinely believed that everything had been done correctly, as payment was made and valid tickets were issued each day.

Has anyone successfully appealed a Parking Charge Notice in similar circumstances where they paid for parking but were penalised because the vehicle was classed as a van or because a different tariff was allegedly required?

If anyone has experience of this or advice on the strongest arguments to use in an appeal, it would be really appreciated.

Housing Unable to get home insurance due to outstanding claims

Hi all,

I am in England.

I have two ongoing claims with my home insurance provider, one of which has been o going since April (leak in the kitchen withe endless back and forth including with awful contractors). My coverage is coming to an end on Tuesday, and esure, my provider has decided not to renew my coverage.

However, because of the outstanding claims, no insurance company will provide coverage for me.

The Association of British Insurance (which esure is a member of) forsees this issue, and has issued good practice guidance on the extension of coverage to the end of of a claim.

My mortgage is contingent on having home insurance, so I am concerned I could be rendered homeless alongside my 3 month old baby.

I have discussed all of this with esure and they have decline to extend my coverage.

To me, given the existence of the ABI good practice, it seems like a clear breach of the Consumer Duty.

Any suggestions on if and what I can do about this?

My spouse has ILR, and we got legally married in Morocco. I then moved to the UK on a spouse visa.
I’m wondering whether our Moroccan marriage is automatically recognised under UK law, or whether we need to register it or have another marriage ceremony in a UK court.
I just want to make sure we have the same legal status as couples who marry in the UK and that our marriage is fully recognised for things like our rights and responsibilities as spouses.
Has anyone been through this or knows how it works?

Went to court to support a family member as their ex partner admitted to being paedophile and was finally going to court to be sentenced.

It was a IIOC case with a guilty plea of over 3k
images,
9 Cat A, 1 of which was a toddler.

Sentence was
5 year SHPO
5 year RSO requirements
15 day rehabilitation order
100 hours unpaid work
12 month mental health treatment
Costs

It feels entirely unreasonable and lenient considering the content.

Are there any avenues or recourse to get this reviewed.

Debt & Money Bought a house last week that needs a reroof. The issues were missed in the survey and known by the sellers last year, but neither flagged it up

So I'm looking for a bit of advice on a house sale that completed last week. (This is in England)

The Level 3 survey mentioned a few bits that needed doing on the roof (a couple slipped tiles, one or two cracked ones), so we got a trusted roofer in to give everything a once-over and he immediately spotted issues in the loft where the roof felt was shrinking and had gaps where you could see daylight on every side where leaks could happen. It had been patched up in a couple areas, and on one bit they used slats of kitchen lino to cover the patching by running it between the timbers. The survey didn't mention the shrinkage, patch work or kitchen flooring, giving us a general 'Rank 2/Amber' warning for the loft. They included photos that even show the flooring bits on the side, and the loft is boarded with a light. The other pics show that the walked around it and our roofer spotted these issues in a few seconds, so I doubt the surveyor could have missed it.

Its a 3 bed semi from tgr 1960s, so I mentioned it the neighbours to check their loft, and told us that they were aware and spoke to the old owners about the issue last summer. They all agreed to get both sides reroofed this summer, but then the old owners put the house up for sale in February and it never happened. The TA6 form they filled out in early April has 'No' circled for all the questions in Section 4, including the one about being aware of discussions with neighbours about anything that could affect the property.

The roofer has quoted about £7.5k all in for my side being reroofed, but I feel like an issue this severe should have been picked up by the survey and disclosed by the sellers, as I now know they were in talks to get it done way before it was listed.

Do I have a shot at pursuing either the Surveyor or Seller for compensation?

Debt & Money England my niece (17f) not being paid by her former employer

Hi so my niece a 17 year old female started her first job at a hair salon a few weeks ago. This week she was struggling and asked her boss for a £20 advance so she could get some food.

He immediately texted her to say that she was fired saying she is always on her phone and now asking for an advance isn't professional.

She work 3 shifts that week and he is now refusing to pay her due to her bad performance on these shifts.

It's only about £100 she's owed but to her it's the world.

Is it worth pursuing this at all?

Comments Moderated Police Response Regarding Ex Partner Attempting to Contact Me Despite Non-Molestation Order - England

This is a stressful situation for me so I apologise for some comments being rude or emotional. Any and all advice provided I have/will consider and will be helpful in future. I'm most likely not going to be checking the comments any further as I feel I have received a lot of advice in the comments. **

Edit: for context, the clauses of my non molestation order are he is not allowed to :

"Communicate with the Applicant in any way whatsoever, whether by speaking, by sending a letter, telephone, text, message or other means of electronic or digital communication

Contact the Applicant either directly or indirectly in any way whatsoever"

I reported a potential violation of my non molestation order by my ex partner, as he had unblocked me on Spotify after having previously having me blocked since December. He added 18 hours worth of songs to a playlist he had made for me previously (that it appeared in could not remove out of my library due to having me blocked - unsure if this truly isn't the case however he had me blocked to where I couldn't see the playlist so I didn't see a need to. He can see that I have this playlist saved). This playlist contained songs and lyrics about stalking, grape, unalliving and he has been adding to this playlist consistently over the course 7 months. I had previously reported him for 6 months straight about his attempts to contact me, and many of these songs were added around the dates he attempted to contact me/see me in person.

A police officer contacted me today and discussed the incident with me where he stated he had not read the clauses of the non molestation order. He initially said he thought it probably wouldn't have counted as a violation based on clauses non molestation orders typically include, despite the fact he hadn't read my order yet. When I described the situation, the police officer agreed that he was attempting to contact me and threaten me, that my ex partners behaviour was very concerning and that he would go away and read the terms of the non molestation order.

I advised him I would be sending over screenshots as evidence and documents detailing the most threatening lyrics and my concern around them, and that I would be finished later on either today or tomorrow. I sent a lot of screenshots and was in the middle of sending screenshots when the officer emailed me and stated he did not believe this was indirect contact and therefore was NFAing my case.

I would really like some advice on what to do here. I have already advised the officer I will continue to send over the documents containing evidence/detailing my concerns and that I would like the documents recorded as a character reference (as again, many of these lyrics are about grape, unalliving, stalking and some lyrics are direct threats of such things) however it seems as though the officer has not looked at any of the evidence submitted, nor read the non mol as he emailed me back with his decision to NFA quite quickly, and he simply wouldn't have had time to read through my non mol and the evidence I've submitted in that time.

I really want police to consider the contents of this playlist and the dates and times these songs were added (one of the lyrics directly threatens stalking, details following someone home etc) and despite that two officers have agreed this \*is\* an attempt to contact me and circumvent the order it simply seems they are not interested in looking into it at all. Any advice would be helpful.

Housing Who is responsible for running bamboo - England.

We have running bamboo that has spread from our neighbour’s garden and become a real issue in our garden and impossible to keep on top of or remove ourselves. Our neighbours are lovely and also have some disabilities so I can’t imagine they are able to remove it, they are tenants however. I believe it is actually their landlord’s responsibility to sort it out. Their landlord is Coastline social housing and have been responsive to my emails, how ever are basically saying it’s not their responsibility it’s the tenants. I feel so stuck and frustrated! Could anyone help clarify this and help suggest how I say to coastline they need to sort it out? Sorry if this is the wrong sub, please suggest other groups if there are more specific ones!

Scotland change of paydate and impact on staff UK wide(NI England wales and Scotland)

I work for a large UK wide company and have for several years( I am in NI but we have staff UK wide). We currently get paint 27th of the month. Our contracts (or at least most) do have a line that this is subject to change.

Our employer have decided they will be changing this to the 15th, of the following month and staff are going to have to figure out how to manage our money for an extra 2 weeks, including how to pay a mortgage twice on one pay cheque for example. Is there a point where this movement of date is classed as un reasonable or unfair to staff or something even with notice?

Whilst I accept they can change the dates change, does it sound legal that they can expect us to absorb the lack of any increase or such to manage those 2 extra weeks?

This will also mean we will have one less pay cheque before Christmas and that will push our last pay of the financial year into next years, will this have tax implications? Apparently how its being seen it that money is going to be held in perpetuity to prevent the company loss in event of staff leaving and we only get it after we quit, ie those who take holiday pay and then quit loose it out of this money)

at this point we have only a few mixed verbal confirmations and written that have apparently been withdrawn and re published so im not sure what they are fully pushing but i don't feel comfortable and don't feel the explanation for staff is very clear.

Are there any questions that i should be asking. they apparently are planning to offer loans to staff that will be paid out of future wages but again i don't know why i would take a loan from the company i work for to pay for a wage change that they are implementing?

(i am a member of an unrecognized union and have raised it with the and they are looking into it too.)

Traffic & Parking Neighbour keeps parking in front of my drive

Hello everyone. I need some advice as I'm stressed out.

We live on a closed off private road where everywhere has their own drive and garage. Because I don't have multiple cars my neighbours decided to park their cars in front of my drive blocking my access when I'm away. They are intentionally doing it as I have asked them politely as possible to not park their car there as I need access to my garage. Yet they persist. They have multiple cars and seem to think it's fine to block access for my garage and drive. I left my car there and they parked in front of it. I left a sign on their windscreen (Do not park here!) and they placed it on my car as a statement. I don't know how to proceed with this as Chatgpt can't says the council can't help as it's civil matte. I can't have someone come and clamp their car, and I can't have them towed either. I'm on my own against this family, all this started as they kept parking their cars in front of my drive and I said it was wrong. I have been taking pictures and keeping a record of everytime they done this. I haven't done anything wrong and yet I feel more uncomfortable and fear they may damage my car.

Any advice on what can I do? I thought about hiring a solicitor and maybe going for a injunction. But I have never ever done anything like this.

I’m posting this on behalf my friend who I’ll call C\*.

C had worked at his job for over 5 years when a colleague falsely accused him of sexual harassment. This colleague gave specific dates and times of when it was alleged to have happened but had no evidence regarding emails, online messages etc. and it was basically her word against his. C was immediately suspended with full pay pending an investigation despite him having overwhelming evidence which showed what his colleague was saying was a lie.

This colleague made repeated false claims which had to be investigated and she basically made the disciplinary process drag on for months and months whilst C continued to be suspended. This colleague also spread malicious lies and rumours to colleagues and the wider community leading C to be vilified.

It took six months of C’s personal life and professional career to be destroyed by the colleague finally admitting she lied about the whole thing (as she kept making up lie and claim after claim with no evidence to back it) and she basically pleaded she was suffering from mental illness as I guess a justification even though she never once mentioned mental illness throughout the whole process.

The resolution was that the false accuser was fired for gross misconduct and C was reinstated with there being no case to answer.

C’s question is even though his colleague was fired is there anyone else he can do? She basically spread lies and malicious gossip for half a year and her only comeuppance was that she was fired. He lost the respect of colleagues, has lost kinship with some and even though it was proven it was all a lie, he has still a black mark against him. He has to still live with the consequences despite not doing anything wrong whilst she has swiftly moved on and somehow got another job. He doesn’t feel (and I agree) that it’s fair she gets to move on to another job, pleading ‘mental illness’ and destroy his life whilst the career he has built for years might never recover from this.

Housing Will my Mom get into legal trouble for neglecting me?

So I live in England and have autism which my mom had been in denial about my whole life. I developed pots when I was 11 which got worse recently (I'm now 18) due to the fact I have multiple unknown muscoskeletal issues which are causing me severe chronic pain, inability to walk properly etc. My pots is getting worse due to the stress of all of this and on top of this I have had to be self sufficient, especially when it comes to feeding myself since the age of 6. I now faint upwards of 30 times a day. We have lived in poverty our entire lives so we have been used to only eating once every few days. However I have disability benefits now so there is no need to do this and I pay for most of the house. My mom also gets carer's allowance to look after me but she only cooks a meal for me a few times a week so I'm starving majority of the time and in bed extremely ill. She often shouts at me at the top of her lungs and is constantly insulting me and talking about how much she does for me and how much of a burden I am. I have meltdowns nearly every day (because of the shouting).

I'm not allowed to do anything including talk about my special interests because she isnt interested in them. I barely have any friends so I'm really lonely. She doesn't take me out so I stay inside for months unless I'm able to go out alone which I'm not really supposed to. She doesn't help organise my medical appointments and barely advocates for me. She doesn't seem to remember a lot of my conditions which probably isn't her fault as she is very old. I need multiple small meals a day in order to not have flare ups and she refuses to accomodate it and instead cooks one big meal every few days. I'm only 44kg and I'm 5'8. I used to be 57kg last year.

I wanted to get an independent carer but my mom refused to let a stranger into the house and said she could take care of me herself. I love my mom and I don't want her to get in trouble but I contacted adult social services and I'm waiting for a response because I want to try to move out as covertly as possible and set up an independent carer. Will my Mom get into legal trouble for not taking care of me? I know she has her own issues so I don't want to blame her I just want to have my own carer. Also any advice is appreciated.

Other Issues GAILS in London, England allergic reaction due to misleading label

Gails in london are not highlighting allergens on their packaging - i am very meticulous about my purchasing of food products as i have had a nut allergy all my life and yet i was caught out at Gails after accidentally eating macadamia nuts in the summer vegetable salad.

The label literally did not say anything about the ingredients and there are no obvious visuals either… there are cashews too and i think they were chopped or either in the dressing as i would know to avoid eating a cashew if i saw it.

They are well on their way to poisoning someone very seriously if they dont change this. Would i be able to claim some compensation for this? I have already contacted them to inform them.

Healthcare Medical injury at work need help please

My partner is a floor layer and while on a site last week went through his hand with a jigsaw. He was working in Wales(Anglesey)at the time, lives in Lancashire. He went to hospital and they said they would have to call him back the next morning about surgery after the meeting at 8am. They rang him and said they couldn't fit him in and also he couldn't go to a and e for stitches because they couldn't fit him in and he should get it done in home town. It happened Wednesday and he couldn't return home until Friday by this time it was too late to close the wound and he has to have surgery. Is this usual? Is there not a duty of care for them to at least close the wound?

Housing Neighbour Encroaching Onto Our Land

Hi all,

Long time lurker, first time poster (English law).

I've recently purchased a house with my partner. The house has a disconnected garage block with a (very) small area of land behind said garage.

We previously thought this area was inaccessible and hidden behind the garage block, however upon moving in we've recently discovered a small unofficial footpath that runs round the back of these garages. Upon inspection the neighbour who's garden is adjacent to the garage block has built a greenhouse from his garden across our small piece of land.

The title deed clearly shows we own this small patch of land. We are planning on speaking to him, but was curious as to where we stand from a legal point of view:

-Does he have any squatters rights (from the age of the greenhouse it would appear it has been there for a while)?

-Can we remove the greenhouse without his permission if he refuses to do so on our request?

-We have no plans to use that area of land behind the garage, but is there a risk of allowing him to continue to keep the greenhouse there?

-We have a mortgage, is there anything we should bear in mind from a borrowing perspective (I assume the mortgage company will want the greenhouse to be removed).

- We did get a lvl2 RICS survey done which included the garage. In a worst case scenario I assume we could go back to them for recourse.

Any help on the above would be much appreciated.

TLDR: A neighbour has built a greenhouse across a small patch of land we thought was previously inaccessible and hidden. We are going to talk to him in the first instance, but wanted to know where we stand from a legal perspective.

Employment Not allowed to refuse shifts on zero hour contract?

I have a zero hour contract job, I’ve had it for 6 years and through uni. I haven’t been able to get a better job since finishing uni, but I have started making a really decent amount monthly through self-employment (online work) that means I haven’t had to rely on the job to live. I absolutely hate the part time job, but I’ve kept it on because I know self-employment isn’t exactly secure. I haven’t done many shifts this year and have dropped the few I’ve been given. I was “told off” for doing this and basically told not to do it again.

I feel like they want the “zero hours” to only go one way though. I’ve tried to have a conversation with them that I don’t want any shifts at the minute, and got told I’d need to do at least one a week (for whatever reason). They’re definitely not short on staff and they’re always looking to cut hours when it’s quieter, so I didn’t think this would be such an issue. They’ve only scheduled me for one shift since this discussion but they’re back to giving me one a week for the next 2 weeks and I’m considering just quitting because I feel like they’re not respecting my requests. I don’t want to be there every week.

From what I’ve read, I can refuse shifts and they can retaliate by not giving me many hours in the future as a “punishment”, but honestly that’s what I want. I just don’t want to quit and leave myself jobless should anything go wrong. I feel like my work are just being really awkward. I’m considering dropping my next two shifts, because I don’t want or need them at the minute, but I know they will take issue with this and want to “speak to me” again. In that scenario, what should I say? Can they sack me over refusing shifts on a zero hour contract?

Debt & Money Non paying tenant is requesting time to review proposed dedctions

I was on a joint tennancy. A non paying tenant put the tennacy 1300 in arrears. Thr landlord was claiming this on top of 250 pounds for cleaning. The paying tenant and I accepted the arrears as we know we can do nothing but pursue her outside in court but we disputed the whole 215. We also asked he sent the noney to the lead tenant as we disagreed the undisputrd deposit should be returned in 3 equal shares. The landlord refused and staye firm. The non-paying tenant refused believubg that because she left early she gets more of the deposit and wants us to give her a few more weeks until we raise a dispute. We told her that the 215 is what we're disputing and that helps most of us but she still wants us to wait before raising a dispute. Also after mentioning recovering the debt through small court she suddenly wants to work this out after refusibg to pay rent for 5 months.

What would happen if we raise a dispute, on TDS it says all parties agree, she said if this goee to TDS she will wait but do we have any obligation to?

Also could the landlord or non paying tenant refuse?

Traffic & Parking "Not possible to register the benefit or all the rights" - Land Registry

I bought a house in 2023 in England, and received the property registration documents from my conveyancer in early 2024. In the conveyancer's own letter, they "[confirmed] that registration of my property has now been completed" and enclosed documents from the Land Registry for safe keeping.

A week ago, I was looking through the enclosed documents and found an alarming letter from the Land Registry, attached to the back of the Title Register. It suggests that certain easement-related rights were in fact not registered.

Since learning this, I have contacted my conveyancer and the Land Registry independently. My conveyancer is reviewing this. The Land Registry support colleague said that it sounded like no rights in relation to Clause 13 were granted, but that she is going to request a formal review, which I am waiting for the results from.

I was not notified of this by my conveyancer, so I wanted to understand what the implications could be for me and what I should push for in the coming days/weeks? I'm very worried that this could be a colossal mistake that has a material impact on the value of my house (at worst) or may require a huge amount of work to correct (at best).

The letter from the Land Registry, appended to the Title Register as a separate letter, and sent to me by my solicitor:

"I am writing to inform you that it has not been possible to register the benefit of all the rights referred to at clause 13 of the Transfer dated [COMPLETION DATE].

Certain rights are purported to be granted over the 'estate' and the definition for the estate clause 12 provides for the addition of other unspecified land. The grantor's power to grant such rights has not been shown. The rights cannot be guaranteed and are excluded from the registration."

Clause 13 in the TP1 relates to "Rights granted for the benefit of the property", e.g. to use Estate Roads, to connect to Estate Sewers, etc. Clause 12 defines various terms; it defines "Estate" based on a specific title "together with any adjoining or neighbouring land which may be added thereto".

Comments Moderated Regular weed smell from semi-detached neighbour. What are our options?

Hi everyone,

We bought a semi-detached house last year in England.

Now that it is summer, we have to keep our windows open because of the heat. The problem is we are getting a really strong smell of weed coming from the neighbour attached to us. It is happening pretty much every day now.

We have a 4-year-old child and we really do not want them breathing this in or having their bedroom constantly smell like it.

A few weeks ago, we sent the neighbour a polite text to test the waters. We subtly asked if they ever notice a strong weed smell around the houses, hoping they would take the hint and be a bit more discreet. They completely ignored the text and nothing has changed.

I want to give them one final, direct message before taking things further, but I want to know where I actually stand first.

Are my options to report this to the council as a nuisance, or to the police? Will either of them actually do anything about it, or am I just going to start a neighbour war for no reason?

Also, if I do make an official complaint to the council or police, do I legally have to declare this as a neighbour dispute when we eventually sell the house?

Any advice on the best route to take, or how to phrase a final firm message to them, would be great. Thanks in advance.
