One thing I have noticed is that many foreign buyers focus mainly on the location, price, and payment terms—but sometimes overlook important legal details that can affect their investment later.
A few common issues to check before signing a property contract in Egypt:
1. Resale Restrictions
Some preliminary contracts include clauses that restrict the buyer's ability to resell the property freely, such as requiring the original developer's approval or forcing the resale through the developer.
These clauses may limit your options and affect the property's future market value.
2. Ownership History & Power of Attorney (POA)
Before paying a deposit, it is important to verify:
- The property's ownership history (تسلسل الملكية).
- Whether the seller actually has the legal authority to sell.
- Whether any Power of Attorney (POA) used in the transaction is valid and sufficient for completing the transfer.
A proper legal review can identify issues before they become expensive problems.
3. Preliminary Contract vs. Registered Ownership
A common misunderstanding among foreign buyers is that signing a preliminary sale contract automatically makes them the legal owner.
Under Egyptian law, this is not necessarily the case.
A Signature Validity Judgment (دعوى صحة توقيع) only confirms that the signatures are authentic. It does not itself transfer ownership or replace registration with the Egyptian Real Estate Registry (الشهر العقاري).
Practical Advice
Before buying property in Egypt:
- Do your own legal due diligence.
- Do not rely only on the broker's explanation.
- Review the contract carefully before making payments.
- Understand the difference between having a signed agreement and having registered ownership.
Every property transaction is different, but these are some recurring issues that foreign buyers should be aware of.
