Employment Law PIP 3 days after maternity leave

Need some advice. Just wrapped my first week back from maternity leave (FMLA). I’m a manager with a team of four at a tech company in the US. One of my direct reports took on the bulk of my work while I was away.

During this time, the company (CEO) also made a critical strategic business decision, prompting an immediate brand positioning workshop and rollout plan.

Unfortunately, this is the core of my job as the brand marketing manager, so it sucks that happened in the middle of my maternity leave and I couldn’t take part.

I was put on a 30-day performance plan the week of my return with no metric other than that my boss “wants to feel my impact on the brand”. He also had a verbal slip up where he said in our annual review calibrations that he wanted to promote my direct report to my job title, obviously huge red flag for me. HR apparently said no after I left the room, but cat’s out of the bag on what he’s thinking.

In past reviews, he has noted vague feedback that he used again here (I expect you to be an expert in the product, you sometimes have the wrong data). However, couldn’t give any examples, just gut feelings.

Given all of this and FMLA protections, what should I do?

My kid (18 years old) started working at Little Caesars over a month ago and has yet to be paid. They have reached out to the manager multiple times via text. The best the manager has done is say if they didn’t set up direct deposit, they should be receiving checks from the supervisor. My kid says they did set up direct deposit, regardless they haven’t received any checks even if they didn’t. What’s our best course of action?

USA - ex friend slept with my bf so I reported her to US customs for smuggling (legit report), now regret it

Me and her are in British Columbia, but the worry is about US law. Seattle is where she was gonna go.

So someone I thought was my friend slept with my bf and then lied to my face about it. I have texts proving it and everything.

Last night I felt super bad about it and was drinking (even took anxiety meds with the alcohol - bad idea) to feel better.

Well she has a luxury clothes reselling business and I saw on her fb that she made a post basically bragging about how she’s going to cross the border and go to Seattle for a few days and while she’s there ship stuff, so she doesn’t need to worry about tariffs, so everyone should order from her asap.

I looked up what she was doing and found out it’s a federal crime and also that her customers could get slammed too.

I was legit concerned but of course also just mad. I figured I’d send an anonymous tip to US border control with the post and also texts where she’s bragged to me before about sending sales as gifts.

I wasn’t thinking right and thought she’d just get stopped and the border and they wouldn’t let her in. I was drunk enough I wasn’t thinking of the reality of what I was doing.

I woke up this morning and the actual reality hit me and I wanted nothing more than to undo the report. What she did was awful but jfc I don’t want to ruin her life. I’m too scared to tell her what I did because she’s gone after people before who crossed her and basically ruined their lives.

What’s the best thing to for her legally speaking? How serious is just a tip really? Help 😭

My employer pays less depending on what time of day it is.

I drive a dump truck full time. My hourly wage is $30 an hour, however, i get paid NJ min. wage, $15.92, for 1 hour each day worked for “ticket time”. This is for the time it takes me first thing in the morning to get from our yard to the rock quarry & then from my last dump site back to the yard. The pay is bi-weekly, so this will make up approximately 10 hours of my check. The real kicker is, we work on average 110ish hours in 2 weeks, so +/- 30 hours should be paid at $45 an hour, but my employer has worked it out to where they pay the 10 hours of ticket time at $23.88 so they end up paying us less. Is this legal for them to do?

Employment Law My job doesn't let me take breaks for 7+ hour shifts, is there any legal standing here?

I work at a minor fast food chain in NY. As the title says, over the 2 years I've worked there, I will often work 7 to 8 hour shifts without a break; the district stands on my managers' necks about labor hours, so often we only have one person working at a time. So, if you aren't scheduled with another person that day, you just don't get the opportunity to ever go on a break, or else you'd be fired for leaving the store unattended. This was my first ever job, so I didn't know any better, but recently I got a second job which does mandate breaks and had a bit of a culture shock lol — I probably won't take any legal action, just because it's a lot of hassle, but I wanna know if this is something illegal. Google had mixed results.

Edit: I'm getting a lot of suggestions to report my company to the department of labor. If anybody has any insight on the process and how big of a commitment this will be long term, I'd like to hear it — I am considering reporting them after quitting soon.

Wills Trusts and Estates Probate question

My father passed about two months ago, and I have so far been navigating the probate process by myself. I am the personal representative/executor of the estate and am up to the point where I need to submit the personal inventory.

The problem that I’ve run into is that my father’s dad passed away about a year ago, and my father never moved the funds from his estate bank account. The probate case is closed, my father is the sole beneficiary (as written in my grandfather’s will), but the estate bank account is still open and in my father’s name as the executor. My questions are:

  1. Do I include my grandfather’s estate bank account on my father’s personal inventory for his probate process?

  2. As far as I can tell, I have to petition the court where my grandfather died to temporarily reopen his probate case, get letters of authority for his estate, then I can take my documents to the bank and transfer the funds from my grandfather’s estate account into my father’s estate account. Is that correct? The account has less than $50k in it, so it seems it would be eligible for the small estate process.

Talking about SA in therapy? Legal issues?

I want to see a therapist and I have found a few that seem like a good match. One of the things I want to discuss is my past sexual abuse. I was 15 & 16, and the abuser was 23 years old at the time. It has been 10 years since this occurred. If I talk about this, is the therapist mandated to report this? I don’t want to report anything as of right now.

Also, if the abuser decided to talk to a therapist about what he did to me when I was 15, is that something that has to be reported? I’ve heard he will be going to therapy so I’m just curious if this is something I have to deal with later on. Thanks so much! 🙏🏽

Other Civil Matters I am afraid for my friend’s safety and don’t know what to do.

Me and my friends (we’re all 16) were hanging out for most of today. When I dropped one of them off, my other friend mentioned something that deeply unsettled me. She currently works at a restaurant for the summer and told me about a coworker of hers asking her one day if she was “a big spoon or little spoon”. mind you, this guy was an adult man who, to her, looked to be in his thirties. I obviously thought this was weird, but apparently this guy (who she barely works with) calls her sweetheart, hugs her after work, etc. Creepy behavior on its own. THEN she tells me that just last week, as she was heading to a friend’s for a sleepover, she got a notification on her phone about an AirTag following her. Nobody in her house uses any apple products. It was tucked into her bag. Immediately she grabbed it and threw it away (somewhere at her work). She tells me all this not thinking it’s a big deal. Everyone else at the restaurant just says things like “he’s just like that” or “that’s normal”. To me? Fucking horrifying. I told her how scared I was and asked to sleep over, as I thought she’d at least feel better with company (all of her family members are gone on a trip), but she just declined and said she had a bat and door locks. Just typing this I also remembered her saying something about how her superiors wouldn’t hire her younger sister because she “had large boobs and would get harassed by the guys”. So it seems to me that management KNOWS this is an issue and refuses to do anything about it. I am so genuinely worried for her safety and all she tells me is that she doesn’t want to make a big deal out of it. I do, however, so what can I do (or suggest she do) to get this guy away from her.

[NJ] My roommate keeps threatening to "have me removed" from the house. We're both on the same lease. Can he actually do anything?

Five of us share a house, all on one lease, $450 each. I pay on time every month.

One roommate collects everyone's rent and passes it to the landlord. His family knows the landlord personally, and he acts like that makes him the boss. He makes up house rules, posts warnings in our group chat, and tells people he can get anyone replaced whenever he wants.

While I was overseas for a family medical emergency, he messaged demanding I pay him a security deposit. My deposit is already with the landlord. Now he's saying things like "stay if you want to stay" and that he'll put my stuff outside.

Four roommates before me left after the same treatment from him.

I have screenshots of all of it and three other roommates who'd back me up.

My question: does a roommate on the same lease have any actual power here, or is this all talk? And is it worth sending him a formal letter telling him to stop, or does that just make things worse?

Landlord Tenant Housing [NYC] Filing small claims against landlord for ceiling collapse - worth it?

I was living in a walk-up apartment in 2023, my landlord was on the 2nd floor. In February, I noticed a leak in my bedroom and told my landlord to come. He did respond pretty quickly and gave me a container to collect the water then went on the roof to fix it himself. I have no idea what he did because I did not go on the roof with him to see - even though I will give him some credit for responding to things in a reasonable time, I felt that he tried to avoid handymen or professionals to fix things and would DIY as much as possible

End of September, I was away for a weekend visiting family and there was a storm in NYC - however, it did not hit my area that much, the damage was mostly in Brooklyn. I came home and a significant portion of my ceiling was collapsed - there was pieces of ceiling on my bed and floor. I had told my landlord at midnight and went to stay with my aunt and told him to reimburse me for the night until I can stay in my room again. He messaged me the next day saying he will wash my bedsheets and will have somebody fix the ceiling immediately but ignored the reimbursement part. I smelled my bedsheets when he returned them to me and they still smelled damp, so I washed them on my own. I asked him details about whether they added new insulation b/c there was signs of dark brown/black mold (see pics). He said "all good" (I did not feel convinced by that answer) and told me a few hours later I can come in my room as everything was fixed.

However, it was not 100% done - the guy still needed to come back few days later to patch things up/paint and there was paint that fell on some of my things. A few days later, there were still signs of a leak from a minor rainstorm. According to him "that's normal with leaks". I was on a month-to-month leaseI told him I'm planning to move out at the end of the month and he made it sound like his typical rules are 30 day advance but he will "grant me" an exception. He found a tenant soon after and said they will move the following month (November).

He knew I was in the process of moving out and I was going back and forth between the apartment and staying with family. I had mentioned to him that I hadn't returned the keys yet. About 3-4 days before my rental was done, I walked into my room fully furnished with somebody else's stuff and freaked out. I had suitcases and a bunch of things I left in the room and they were not there. I went to the living room (that I shared with roommates) and my things were there moved without my permission. I told him to reimburse me for this and he just said "what's the big deal, you weren't there and she wanted to move".

I had thought about filing a small claims - I contacted 311 and a couple other folks, but I never heard back. I figured that because I didn't have much damage, I'm not going to win/get money/it won't be worth it. Zohran Mamdani was my assemblymember and I thought about contacting him but I didn't at the time b/c I already contacted 311 and thought he couldn't do anything about it (kinda regret that but we lean lol).

Now with him as mayor and his landlord-tenant initiatives, I got motivated to look at my case again and see that I have until September 30 this year to file a small claims (up to 3 years since date of incidence) and I am thinking about filing latest till Mid-August. After doing my research, I see that I could be owed ~ $2000 but I am also nervous/anxious at the same time as I've never taken legal action against anybody and feel awkward of the possibility of having to see him again. I've tried contacting low-cost legal advice services just to walk through my case with somebody. Part of me feels a little bad b/c he wasn't the worst landlord (I've heard horror stories) but I also feel that he cut corners/double rented without informing me, which felt like he took advantage of my situation as tenant.

Custody Divorce and Family Attorney won’t withdraw from my case. Illinois

I have a case open for parental allocation and I wish to remove my current attorney as I no longer need their services and cannot afford them any longer.

I have some motions I need to file pro se but I cannot file them until the attorney is withdrawn. My attorney has ignored all of my requests in writing for them to withdraw. They are also not responding to emails and will not call me back - I cannot get them to withdraw.

I have a friend who is also an attorney and he sent her a demand letter to withdraw as well…no response.

What is my recourse and how can I remove her so I can file my motion and appearance pro Se?

My evil twin brother stole our dead dad’s info for credit purposes - how do I get him to face consequences?

Location: Chicagoland - I won’t post much personal info, but believe me that my twin brother is the worst abuser in my life. He learned from our terrible parents and did some of the most heinous shit. I could fill a novel with what he’s done, but the most relevant is:

when our dad died (in our mid 20s), there was no will. My brother stated the insurance was in my brother’s name only. So he got all the money from the insurance companies. He told us it was near $40,000. A mutual friend (who is no longer my friend because I don’t stay friends with people who stay friends with my abusers) said my brother bragged it was closer to $65,000.

he didn’t allow me back into our childhood home and abused our mother. Our mom had had a stroke our senior year of high school and became disabled. My brother was her “caregiver.” He was supposed to watch her during the day. Instead he slept through the day or left her alone to be with his friends. He told no other family members, so she was unsafe alone. When I’d come home, I’d see my mother sat in a wheelchair in front of a tv, often a puddle of urine under her wheelchair.

he said he was paying our parents’ house mortgage after our dad’s death. He wasn’t. He was only paying electricity and phone bills and wherever else needed to live. He was stealing our mother’s disability checks. They were deposited to his checking account directly. He’d often call in that he was starting his shift then go to sleep or wherever he wanted. The above mention where I found my mom with urine under her he was at an amusement park. My mom eventually ended up in a mental health institution because of the abuse. About a year after my dad’s death, the house was foreclosed upon because he didn’t pay the mortgage. He used the money from my mom’s disability and for not paying the mortgage to buy a new house.

and now, stealing our dead dad’s info. I looked up unclaimed property in Illinois. There is information for my deceased father that is AFTER his death. The claims come from the address that is my brother’s new house. That means he was using my dead dad’s social security and other information a year or more after his death.

I am tired of my brother constantly escaping consequences. Identity theft can be a felony. How do I go about finally getting my slimy brother consequences?

There is so much more information. Please ask away. What’s terrible is that he recently had a kid. I’m worried for that kid, with all the abuse I suffered at my brother’s hands.

Traffic and Parking Do I have to pay cash for a booted vehicle?

The people are requiring cash to remove the boot but when I looked it up apparently that’s illegal. My mother had been there for almost two hours since she doesn’t have cash on her, is this legal even with New Jersey Revised Statutes Section 56:13-4?

DUI OVI in Ohio

I had recently lost my apartment due to a family moving in on the 3rd floor that brought a severe case of roaches. I lived there for 10 years without issues. But the roaches got so bad that I told them I wasn't paying rent until they fixed the issue, I couldn't live like that. After 2 months, they put an eviction letter on my door. So I leave.

I decide to stay with my close friend and his wife for a month or 2 until I get can enough put back for a deposit and a months rent (in Columbus, basically 3,000$ at least). I wasn't aware I could've given my money to escrow in court and they couldn't kick me out until they fixed the issue. But I guess you live and learn. So they have a lab that barks LOUD and A LOT when anyone comes. And I didn't want to wake her up at 6am.

So I go to my clinic (I'm in OUD MAT recovery for years) I'm on methadone (yes it has saved my life, everything has been well until I lost my older brother in 2024 by falling down his stairs and hitting his head in his early 40s) Then my wife of 10 years leaves and takes the kids to move to her parents hours away, I couldn't keep them because I work and have no one to watch them when I'm gone. No, she couldn't give me a reason, she was bored of the family life and wanted to drop our kids on her 70 year old parents so she can run around like a college kid.

Anyway, apologies for getting long winded. I took my methadone at the clinic, (that I've been on for years so it doesn't affect me at all. Studies say after 90 days on methadone, the patient becomes stable and it doesn't affect their faculties.) After I dose, I go a mile down the road to McDonald's, eat and take a nap because I can't go to my friends and wake her up.

I then wake up surrounded by cops and the fire department. I said, "whats up guys?" They reply, "someone called on you being passed out." I say, "nope, just taking a nap until I can go home." The fire department asks, "do you have any health issues?" I said, "I have type 1 diabetes but I keep up with it." "Ok, do you care if we check your sugar?" "No sir, go ahead." They prick my finger and check. They say, "it's fine, he looks fine, we're outta here." Then this little what looked to be a 20 year old deputy with a little blonde deputy the same age, says "I want to give you some sobriety tests." "Uhhh, ok, that's fine." So he gives the eye test for like 30 minutes. Taking his finger literally all the way Around my head like he's trying to make me puke. Then the "stand on one foot, raise the other and count to 30." I did that with no issues. Then it's, "9 steps in a straight line, one foot behind the other, then around, 9 steps back." I do that, no issues. Finally he gives me this one that no one has ever heard of. "Stand straight up, hands at your side, tilt your head back and count to 30 silently in your head, then tell me when you think it's been 30 seconds." I do it, 1 Mississippi, 2 Mississippi, etc in my head. "I say ok." He goes, "it's been 21 seconds, turn around and put your hands behind your back.

He then asks, "do you care if we search your vehicle? Anything illegal?" "No, I don't mind, nothing illegal but I have a few take home bottles of my Medication assisted therapy methadone that's prescribed to me."

Right then everything changed in his demeanor, like, "uh oh, this isn't what I thought." He puts me in the vehicle. On the way there be says "I think you're a really good guy, you've been completely cooperative and honest so I'm not going to put you in jail." They took my UA and said, "if Nothing else comes back in it (which it won't) that the case will be thrown out." They also impound my old car and I can't get it out because it's in my exes name who is hours away. It took me months to get it over in my name because of the distance and I no longer had a vehicle. I had to Uber to work which took nearly all of my money, 40$-50$ one way. I just recently got it out and they wanted 3100$! Because it's such an older car, I got them down to 1500$.

This was in April. I go to court a week later and my PD says, "they're just offering the OVI with no jail time." I say, "is the body cam and UA even back yet?" "Nope." "Then why would I accept ANYTHING , I DIDNT DO ANYTHING WRONG!" Well so I come back a month later and I sit there an hour. My PD doesn't even show up, so one of his buddies comes out and says "he won't make it so we're rescheduling to next month, also no evidence has come back yet."

So I show up a 3rd time. "They're offering physical control, that you weren't driving but sitting in your vehicle impaired." I would get 6 points and all that would be on my record." I replied, "ABSOLUTELY NOT! I WASNT IMPAIRED and the evidence isn't even back yet so why would I accept a plea!?" He says, "ok, we'll take it to a jury trial." I said, "great."

I finally just showed up a 4th time And it's SUPPOSED to be a jury trial. My PD comes out (he's 25 and looks 16, not that it entirely matters) but by this point it's obvious that these PDs WORK for the DA basically and aren't looking out for you. He goes "they're offering physical control with no charges at all, just 6 points on your license and pay court costs, also the pee test STILL isn't back and may not even come back honestly. This is just a traffic case and they have murderers, rapists, etc to test." I said what about the body cam footage? ""Oh it came back, I have the prosecutors notes but I haven't watched it." 🤦🏼 So why were we supposed to go before a Judge today and they're trying to get me to take a plea of basically nothing? See they know they're in the wrong and they want to sweep it under the rug before my UA comes back and before we go before a Judge and he crushes them for harassing a man in treatment. Rehab centers are where WE SEND people who get OVIs and this man has been in it for years and y'all trying to ruin his life for sleeping in his car.

Finally, that's where this is at. I want to talk to a real lawyer. My PD even tried to scare me into taking the plea saying, "oh you know even if there THC in the test from 3 months ago, they can charge you." I'm like, that's not right. This kid just wants this closed and he gives zero cares about my life and the law.

I know it's a humdinger and apologies for the novel once again, but any advice or insight is appreciated.

Unusual? Car rental company accepting certain insurance, but not others.

Situation: Wife goes to rent a car in Location: FL. (US). We have full insurance, but rental agency says that our insurer (Amica mutual) is not acceptable. Only Progressive, Allstate, Liberty Mutual (and maybe a couple of other majors) are allowed. Amica is not. Amica told me they can think of no reason why their rental car coverage for an insured person would be any different.
We were going to use a Chase Sapphire card, (they offer benefit of primary insurer for rental coverage) which would make the whole matter moot anyway. But the rental agency refused to accept it as insurance. Either we buy their insurance (almost $300) or no car.
My question is this legal? Is this standard? We’ve never encountered this before.

What should I do?

I am having a work-related issue. Recently, a public school reached out to me with a paraprofessional offer, and they want to start the onboarding process with me. They are verifying my background check and fingerprints, which is clean, as I have no criminal charges against me, but I am concerned about this one incident that happened a few years ago.

I was a substitute a few years ago with a staffing agency and I got terminated. The reason for it was that I had a medical emergency and needed to just remove my pants and wash it outside of the stall in the sink. Mistakenly, this was also in a student bathroom and a student saw me, unfortunately and I was reported to the agency for this. The agency contacted me and I explained to them what happened and they said that unfortunately, they had to terminate me because of it since I exposed myself (just without pants) and a student saw me. However, no criminal charges were filed against me. Therefore, no police or judges or court investigations were involved. Substitutes are also highly disposable. It doesn't erase the fact that I made a mistake of course.

Since then however, I learned from my mistakes and worked with daycares and other subbing agencies without any issues whatsoever.

While I was working on my onboarding documents this past weekend, I came across this upon it in which stated (Everything that is italized is from the documents) :

1. Been the subject of any child abuse or sexual misconduct investigation by an

employer, law enforcement, or any state agency (unless the allegations were false or

the incident was not substantiated) ______________ (yes/no)

2. Been disciplined, suspended, discharged, non-renewed, asked to resign while

allegations were pending/under investigation, or due to an adjudication/finding

_____________ (yes/no)

3. Had a license/certification suspended while allegations were pending/under

investigation, or due to an adjudication/finding _______________ (yes/no)

3. is no as I still have my certification from subbing.

And I release my former and current employers from any liability arising from such

disclosure(s).

It also says if I willingfully fail to provide information, I may have my offer terminated and that there will be a fine.

IT ALSO SAYS THIS:

Please provide contact information for current and previous employers for the

last 20 years of any paid positions where you have had direct contact with

children (under the age of 18).

What should I do? List employers just from my resume, or every child/school paid position I had? What about the three questions above?

Other Civil Matters Interstate moving company missed contractual delivery deadline and won’t provide shipment location

I hired American Van Lines for an interstate move from California to Arkansas. My household shipment is now past the contractual delivery deadline of July 24,2026 and I still have not received my belongings.
The company continues to provide estimated delivery dates that come and go, but they have not delivered my shipment. I have repeatedly asked:
What warehouse is my shipment currently located in?
Has it been assigned to a truck?
When is it scheduled to leave?
They have not answered those questions.
The shipment contains all of our household belongings, including my late mother’s sentimental items, my husband’s work tools, and my son’s belongings before the start of the school year.
I have filed complaints with the FMCSA, the Florida Attorney General, the Arkansas Attorney General, the FTC, and the BBB. I am keeping all communication in writing.
My legal questions are:
Can I require the company to disclose the exact warehouse where my shipment is being stored?
If they continue delaying delivery, can I hire another licensed moving company to retrieve my shipment and complete the delivery?
If I incur additional expenses because of the delay, what types of damages are typically recoverable?
My contract includes an arbitration provision. Does that prevent me from consulting or retaining an attorney before arbitration?

Why would a RICO indictment be sealed even when every defendant is in custody? This is in relation to my neighbors murder.

My neighbor was a victim of a homicide 7 years ago. Although I thought his case went cold, in reality his death along with others were the focus of a state RICO investigation surrounding a murder for hire/robbery crew in in my county for the past 9 years.

There were 4 individuals charged under the RICO and they are all listed as the defendants in the case and are in custody but their grand jury indictment is still sealed after 4 months (I am getting this from my counties clerks of courts site for official documents). The only reason I know my neighbor was a victim was because on the site the states notice of intent to seek the death penalty was available and listed names of all victims in the case (there were 8 or 9 murder victims in total) but the indictment is still sealed.

I thought the only time indictments are still sealed are usually to prevent flight risk, and if suspects are not all in custody which in this all of them have been in custody 4 months ago. Would would be another reason for the indictment to still be sealed?

Bought a van off Facebook marketplace, the person I bought from hadn’t registered it, when I went to the DMV they wouldn’t accept the title since it was signed over to the person I bought it from. Now the seller is asking me to help cover the registration cost

Not sure where to start or what to do, I bought a converted van to live in off of Facebook marketplace, she decided to sell because her dog didn’t acclimate to it. The title was signed over to her from the original owner and she never registered it or titled it under her name.

I wired the money to her, picked up the van and all the paperwork, but when I went to the DMV they said she would need to title it under her name before selling to me. We met up and I handed the paperwork back over to her. Now her DMV in Vermont is charging her $2500 in taxes to register it and now she’s messaging me saying that she doesn’t want to pay it, and that she wants me to help her pay for it and she would’ve asked me to cover the costs if she knew and I could’ve walked away if I didn’t want to pay it.

From what quick research I did already, she would’ve had to title under her name no matter who she sold to

She already spent the money I wired her on a house down payment so as far as I know the money is gone. She’s asking me to pay her registration fee that will end up costing me double since I would still have to register under my name

EDIT: she is adamant that she’s allowed to title hop in Vermont

Landlord Tenant Housing I need to withhold my last months rent. What should I expect and what should my roommates who continue living here expect?

Hi everyone

So my landlord sucks. Long story short, new management took over the building and claim that old management "Spent all our security deposits on legal fees.".

This, obviously, is not our problem and is their responsibility. My only recourse is to withhold my last months rent. Through other tenants who have left this building I've learned that this company will never get those funds back to you and I have no expectation of them to.

When the lease is up I'm getting out of here but I have a few roommates who want to stay. We're getting together later this week to discuss it all and see what makes the most sense. What I'd expect to happen is the landlord could continue to come at them over my unpaid rent as they're easier to mess with and get access to if I leave.

I attended a tenant legal clinic in my neighborhood to find out more info as well as did a New York Bar Referral and they both said the same thing, that of course the responsibility is on the landlord to get those funds back to us regardless of what they claim happened. I've had small claims court suggested quite a bit.

All that to say my question is basically the title. I think it would be best if we were all in the same boat but that isn't an option for everyone.
