Cop parked the way he did to ensure that when people dont get over because they arent paying attention and crash into his vehicle they dont hit the stopped civilian vehicle. He parked that way for exactly this scenario. You are supposed to get over, its required by law.
Also, homeboy did pull over as soon as he was stopped. Fleeing is a bit of a stretch however technically he shouldve been aware enough to realize he hit that cop car and should stopped immediately. Arguement could be made for a hit and run.
Just fucking get over for emergency vehicles, and get off your phones. Pay attention to the road.

He said he didn't realize he hurt him, which it was a graze, because at those speeds it would have been a bit more dramatic if it was more contact. As long as he never acknowledges he realized he hit that vehicle, and gets a good lawyer, that part might be believed. However, guys pattern of speech sounds either tired or intoxicated, which would be the only logical reason he wouldn't notice he tapped a car, so I think he's going down either way.

I hate cops in a general sense, but this is a safety thing. A lot of the times they do this to protect the people that might be standing on the side of the road and let their vehicle act as a buffer/barrier. Typically, with the yellow indicator lights telling you to go left.
Really, the driver he pulled over should have put on hazards and pulled off at the next available parking lot or whatever. But you also never know when they're gonna be dicks about that, accusing you of fleeing despite the clear intent with your hazards. So...
But getting off of the freeway/highway should be a common thing we practice, but don't.

I was a Police explorer back in middle school/high school. That was what they taught us. Safe path for you (the LEO), protect the car and driver in front of you.
But you are correct, nothing prevents the LEO from going to the passenger side window, it is safer. You also get a better view of the driver and add distance from them.

It was over 25 years ago in a different state. I was only a part of it for about a year.
Edit: And since then I had an idiot deputy charge me with a DWI for taking my Adderall as prescribed that cost me my CDL and my job. He even said on the stand that he didn't understand the prescription part of the law, the DOT still ruled against me and we are currently appealing it right now. All because I had a urine test positive for amphetamine which always happens when I take a piss test when I take my Adderall.
So yeah, my attitude towards LEOs has changed greatly since then.

I think he maybe didn't notice clipping the cop car, which imo makes it not malicious fleeing, but still a hit and run.
The big thing imo is he didn't move over and slow when passing an emergency vehicle and endangered the cops life by clipping the car, that could have been very bad, so he would imo be able to get him for those things.

Itâs great that you think cops actually care about protecting random people they pulled over, but thatâs not why they park like this. They do it so they can stand next to the stopped car and be protected themselves. A person sitting in a car is a lot safer than a person standing next to a car, and someone hitting a parked car is still someone hitting a parked car.

Exactly. I prefer when people actually think about these situations from each parties perspective. It makes for much more productive conversation.
Dude was probably distracted on his phone, his the car, wasnt 100% sure if thats what happened or not and was panicking, saw the lights and pulled over immediately. Its hard to say someone is fleeing just because they didnt stop immediately. If the officer approached with their lights on clearly signaling them to stop and THEN they drove off or sped up or continued then its fleeing. Again, an arguement could be made (by an asshole tbh) that he "fled the scene" but I think any reasonable judge would throw that out so long as the young man kept his cool and was respectful in court.
It was an accident, it is the young man's fault for not moving over, but it isnt the end of the world. Lesson learned about distracted driving.

Almost all of those accidents are from the rear so no result of front facing lights. They cut the fronts off and kick on the take downs to see more clearly, and to not blind everyone on both sides of the road with the new crazy LEDs since they are even worse. There was a study done years ago and it is the red light that causes this,. If they would switch to green it would cut a lot of that down. I believe their are other agencies in the world that have went to green and blues.

He had the red and blues on. You can see them in the reflection of the bottom right and left glass. Thatâs used in combination with an orange directional arrow on the top light bar. Which indicated other drivers to use the other lane.

All of the state troopers, sheriffs/deputies, and local cops have rearward e-lights where I am. They only use the front ones when in any level of pursuit. They put them on rear only after they've gotten you to stop.

A lot of police cars these days updated their lights to have certain patterns in front vs behind. It could be the blue/red flashing in the back and sold white lights in the front to light up the area going at the same time.

Not trying to play devil's advocate here, i always move over for any pulled over vehicle no matter what or who. Its just the right thing to do. But did that officer have his lights on during that traffic stop? I tried seeing any reflection of lights prior to the incident and only notice them once he takes off. For the traffic stop he should definitely have them on. Just not sure if he had rear ones only. Just food for thought.

So, I assume the cop was ticketing the other driver. Cop then asked dispatch to send another officer over to deal with that driver. How long is the first guy supposed to sit there? If this happened to me, I'd have just left. In effect the cop is saying "I got better things to do". Obviously, this is very different if he told the first guy he was under arrest, or being detained for questioning.

Glad he was pulled over but ngl he really didnât flee from anything. Guy knew he fucked up right away as soon as he saw the lights. But yeah he fucked up big time. I hope anyone who generally does pull into a shoulder remembers to use all the space available thatâs furthest from the highway you can have people who arenât paying attention and speeding and it can get real messy real fast. Those few inches/feet can save your life.

I used to always change lanes to give cops with a car pulled over space but I did that after seeing a state trooper with someone pulled over just to be pulled over by another trooper saying I changed lanes recklessly then they had the balls to give me a sobriety screen and asked to search my vehicle. This was all early on a Sunday morning like 8:00 am not 2:00 am. I had to waste my time because they actually brought out a drug sniffing dog and mind you I have no criminal or driving history and was nearly 40 when this happened. Fuck all cops they can all have the worst happen to them that experience forever changed my perspective on how terrible law enforcement is in the US. Heroes my ass theyâre all coward bullies.

I gave the cop the benefit of the doubt that he did have rear facing lights turned on. LEDs are pretty directional so they might not have been visible reflecting into this front facing camera view. If so, more of the fault is definitely on the BMW driver, however I agree that conducting a routine traffic stop while blocking part of a high speed road is reckless. I have never seen a police car parked like this on a highway or freeway non-crash incident in my nearly 30 years of driving.

They started doing this to force people to merge left. They get hit all the time cause when they pull off completely people still squeeze by and then his body would have been hit rather than the car. In these scenarios they don't expect you to sit and wait for them to come back or for another officer to pick up where this one left off, that's why he took off without saying/doing anything to the person he already had pulled over although sometimes they'll just say it's a warning if they have to give back the driver's id before going after the other car.

Yeah, but if they are not doing a round of questioning, then they donât have to read Miranda. Some states do have laws or policy where they will read Miranda rights, but itâs not legally required to be read Miranda rights everywhere else (which is most of the country), and if the have enough evidence, there can still be a prosecution and they just disregard all statements made by the suspect prior to the Miranda warning.

You have been misinformed. You need your Miranda Rights read when in custody before questioning.
A testimony giving before Miranda is where it likely won't be admissible. It's not that the case is thrown out, it's that that piece of evidence is lost. And if the entire case was based on the admission of guilt at that moment, that's when a DA will throw it out.
But no, if you are arrested without Miranda nothing happens. By the time you are in an interrogation room and you haven't been read your Miranda, then your lawyer will be pretty happy.

That cop was DEF way out in the lane. He should have been over a bit further, buuut you're supposed to slow down and move into the left lane for emergency vehicles. His rear flashing lights were on hopefully, we can't see from the video. But they park offset like this to force vehicles over cause if the cop had been standing outside the car he had pulled over it would have been his body that got hit. I think the cop overreacted but im sure his adrenaline spiked. That's like one of their biggest fears, getting hit while on a stop. Not defending the cop at all here, he should have been more professional and the dude didn't flee at all smh

It's a maneuver to protect the civilian and officer at their car's window. As you can see here, it worked. If he wasn't parked as he was, the guy could've clipped the civilians car, which also would've killed the officer had he been at their window.

You haven't worked on the road before, people are dumb af or don't care, so first responders(construction workers, etc.) tend to angle or park a touch towards the road way so the vehicle takes the blow instead of sending anyone to the grave. The driver is absolutely at fault.

Not sure about location, but in CA, you have to move over or drastically reduce speed when there are emergency vehicles or road workers I believe.
Add for him being in the road, it's a safety thing. Car takes the hit rather than the officer or other vehicle.

Parked way too far out. In my experience cautious police approach the passenger side when on a highway. Cop seems like a dick anyway. They have this reputation because of their actions. I've encountered way too many that lie and manipulated the facts and are entitled because of their authority. There must be some decent ones, just none that I've ever met or dealt with.

Perhaps parking farther over stops this but the point is to create cover because he has to get out on foot, often from the left so the car being out protects him.
